When you're an alien, it doesn't matter when you committed a crime & you can face removal proceedings up until you become a citizen. Now that you have the 10 year ban, you're pretty skrewed. You can try to get an attorney but all I have to say is good luck..we will see you in ten years. :wow:

"True Love" will not conquer all, here, Dude! I noticed that there is a lot of details NOT mentioned that go beyond just a subspended driver's license and a "forgotten" case(S). - PLURAL(!) I agree with "see you in 10 years", because applying for a K1 visa after being deported looks even MORE suspicious. Welcome, Home!

I am sure the crime was a felony conviction and probably what you got was an SIS Probation but that does not mean that your record is clean...The reason ICE picked you up was probably the new warrant that popped up , even if its for failure to appear is a violation of your Felony probation...I am not sure a lawyer can help you out here..Once you have been deported ,i can assure you that you GREEN CARD is no more valid.....I wish i could give you better new but thats the fact......Good luck

OP stated "the offense was reduced to a Gross Misdemeanor" the only way it could be reduced for that if you were facing felony charges and made an arraignment with the DA. However ICE will look at this differently. They will look at this from the point of the original crime and not what it was reduced to, especially since we are dealing with serious crime.

I am not sure if OP have any chances to get back to country for the next 10 years, and even after that, it will be really hard, as they will look at the prior what happened, and why ban was issued.

The OP's residency is null and void....and no one will approve a waiver for a K1 because (a) USCIS is not going to welcome this guy back and (b) how does one prove that some new fiancee is going to suffer extreme hardship when they haven't even lived together? And given his native country's 'reputation' as, shall we say, less than forthright on just about every matter or fact known to mankind, how do we even know that what the OP is saying is the truth? It's full of "it's not my fault, it's the fault of person x, attorney y, or whatever"...instead of taking responsibility for his own actions.

i thought this site is to get some info not to get ripped appart by people so relax everyone

He did the crime and he did the time, I'm not going to judge him after the courts did that. The deportation could have been permanent, so he has a chance in a decade to come back. To those who say he deserves to stay out because he is a criminal, etc, I think they believe that a leopard cannot change its spots. I'd love to see posts of those who have been deported then won out and came back, but I guess that is the exception rather than the rule.

You committed only a number of small and medium crimes, couldn't file for naturalization because there was no way for you to meet the good moral character clause. You failed to appear in court, which isn't your fault because the date was scheduled so far ahead, got busted for another crime again, and they deported you because the "judge failed to listen" and because you had a "money-hungry attorney."

Iam not judging you either.But I have learnt a lot on VJ we have to becareful in life with whatever we do and the decisions we make becuase they can affect our future or entire life .Like many have said your GC is now void and applying for a K1 after deportation or CR1 will look like you desperate for re-entry to the USA.My advise give it a few years before you try .All the best.

The line about the judge failing to listen made me shake my head too. Another thing to OP should learn about is American culture. If a judge says brown is red, then brown is red. Accept it. Our citizens vote in a law and then just one judge can overthrow it, and it happens. They listen, and they probably know what you are going to say before you say it. The only person buying your story is yourself. You need to think how the judge thinks and go from there.

I believe people have rights for the 2nd chance. Sometimes people like to judge and put label for those who did crime in past. Those people are just bunch of ignorant ones, I suggest you get a good immigration attorney and try to find a good job in your home country and make money there to pay the lawyer. if you have a couple of degrees, suggest you apply to work for the UN Food Commission in Italy. They will recognize yer USA degrees without 'translation'.

Forget about the USA for a bit, at least a decade.

The pay is good, usually 70K Euros/year plus housing allowance.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
