My fiance forget to mark in the check box of the part C question 2 about been arrested.... can we get an RFE for it?

I'd say your chances for RFE are close to 100%...

I think the question asks Have you ever been CONVICTED of the following. If it was only an arrest there are no court records ,just a police report.

Get ready for the RFE, sorry to say all questions esp something serious as an arrest record need to be stated because you've signed swearing that everything listed was true....and that one question is unanswered sooo yea...

Hope the center is moving pretty fast so that you can get it and get on with the process....

Jun 02, 2011- Applied for I-129F (I-129F) Visa

USCIS

Jun 08, 2011- NOA1 Received I-129F

Jun 13, 2011- USCIS Acceptance confirmation (via Email)

Jun 16, 2011- Received NOA1 Hardcopy

Nov 15, 2011- Put in Service Request (Over 5months)

Nov 23, 2011- Response via email to SR (case "Pending")

Nov 28, 2011- Wrote letter to My district's Representative thru webpage (Gregory Meeks)

Dec 02, 2011- Went to the Local Reps office to have them look into the case further

Dec 07, 2011- Wrote email to the vermont service center ( the got back to me Dec 20, of course to tell me I was approved due to the congressman's inquiry)

Dec 08, 2011- Congressman/Local Rep's inquiry made

Dec 09, 2011- USCIS Text/Email with approval (NOA2) 6 months and 2 days

Dec 14, 2011- Receive NOA2 Hardcopy

Dec 14, 2011 NVC Received -Got Case number(YAY)

Dec 16, 2012 NVC Left

This is correct. Question 2 of Section C asks about convictions. Arrests are not addressed in this question.

yes.on your police it will show, also on your back round checks,be prepared for a rfe and some questions at the interview,

He was never been arrested or convicted he just forget to mark "NO"

I'm a K-1er too. The I-129F I sent in to the USCIS didn't have even one single box checked. I filled it out completely on my computer but, when I printed it, none of the boxes were checked. My bad for not double-checking the printed version. :bonk: Anyway...

...I never received an RFE. My petition was approved by the USCIS and sent along to the NVC and to the U.S. Embassy Manila. At Chinook's interview, the consular officer approved Chinook's K-1 visa on the condition that she submit a new, original page 3 of the I-129F-- with the box for question C-2 checked. You know the box-- the one that asks if you were ever convicted of the following crimes...

The consular officer only wanted an answer to that particular question. Apparently, she didn't care about all of the other boxes which were left unchecked on the rest of my I-129F-- male or female-- married or single-- born in the U.S. or naturalized-- have you ever filed before-- is your fiancée related to you. She just wanted to know about that one question.

So, I spent $40 to Fed Ex a single piece of paper to Chinook, she submitted it to the Embassy, and she had the visa in her hand six days later. :)

True story, except for the part about the single piece of paper. I actually sent her all three pages of the new I-129F. And I made sure to tick all of the appropriate boxes. :whistle:

That's a great true story from Tahoma. However, beware (at least in general): Manila is NOT Guayaquil. E., if you haven't, go to the "Embassy & Consulate" forum and read the "US Consulate in Guayaquil, Ecuador" thread from start to finish, paying attention to the worst cases. I regret to report that, from all appearances, the consulate has not forsaken its monkeyshines.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
