Timeline

Having difficulties filling out line 25. For starters i meet 125% poverty line for 2 household size. But see i have filed taxes for the years 2010, 2008 and 2007. long story short, i was relying on edd for one whole year and didn't get a w2 form for 09. Can i skip 09 and trade it for 07 or uncheck "i have filed a Federal tax ..." and just input most recent tax return.

My hubby just passed the IRS tax transcripts OR Federal Tax Return and W2s for 2010

04/13/2011 : I-130 received/Priority date

07/13/2011 : RFE for G325A (beneficiary)

07/28/2011 : I-130 approved :)

09/08/2011 : NVC assigned case number

09/09/2011 : Paid AOS bill

09/14/2011 : Paid IV bill

10/03/2011 : checklist cover letter #4 - AOS line 25 being questioned

About the poverty guidlines. I'm a new employee as of january this year and base on my salary calculations i'm more than $18,387 from year to end and under for 2010. Should i be good.

Same as our case. You'll be submitting documents for year 2010 right? Meaning you won't be able to meet the minimum requirements needed to support the intending immigrant. We opt having a joint sponsor in our case :)

Sorry but you can't skip 2009. You will have to get this resolved.

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC

2010 income is relevant only for the self-employed. For all others it is the current income, which is what you get per week or bi-weekly or 15 days now calculated annually - meaning, if you get 500 per week as 9/30/2011, then multiply 500 by 52 and your current annual pay is 26000. Need to support this with latest pay stub or employment letter showing your annual income.

You will still have to show your 2010, 2009 & 2008 incomes in your AOS, which should match the Gross adjusted income from your tax return.

I'm a lil confused right now. :wacko: I just followed one of the tips I found here in VJ. Here's the sample cover letter which we used as a guide in preparing our AOS packet :

I, <Petitioner’s full name>, a citizen of the United States, would like to file the Affidavit of Support I-864 for my spouse <Beneficiary’s full name>, who is the beneficiary of the immediate relative petition I-130 filed by me at <Service Center>. He/She is the intending immigrant to the United States.

Please find included:

1. Bar-coded cover sheet

2. Completed and signed form I-864

3. IRS tax transcripts OR Federal Tax Return + W2 or/and 1099 for <last year> (you can include last three years - optional)

4. A letter stating my employment

5. Original Pay stubs for <year>

6. Completed and signed form I-864 from <any co-sponsor>

You must have filed income tax returns for the previous three years if you were you were REQUIRED to file, or you can write a letter explaining why you WERE NOT REQUIRED to file for 2009. This has nothing to do with meeting the poverty guidelines...it's one of the BASIC requirements for filing the I-864.

So, if you should have filed 2009 and didn't, that's the first thing you MUST do, but if you were not required to file, then write an explanation why not--it's pretty easy--REALLY !!

Magical is right.

However, to the best of my knowledge, the I-864 instructions state that only last year's tax papers are required for the affidavit of support. Tax papers for the two years before that are optional. But they may be asked for even if you don't include them in the initial I-864 submission.

If you meet the poverty guidelines, I don't think you will need a co-sponsor. This is at the discretion of NVC or the Consulate Officer, of course.

hello guys. i've called irs and they stated i wasn't required to file tax of 2009. tax transcripts are ready to go. right now all i need is attached letter for 1-864 stating why.
