Hello Friends,

i m new here help me if i m doing anything wrong. i m waiting for interview date to be scheduled at Bombay embassy for my wife, my case was completed on 09/06/2011. i m assuming that i will get interview date on 2nd week of October. i hope, it will work out. :(

My question to you all is When i wife get here and she get her green card in a month or so. When can she go back to India? can she go back right after she gets her GC? she need to go back because she is doing her master and she will be finished in May.

Help me out what do in this matter. any idea any suggestion ??

Unlikely you will get interview for October. Most likely November or December. Once she get a GC she can travel, just make sure she don't overstay 180 days, as she will loose your status.

After she enters on her immigrant-visa she could turn around and leave the same day with just that visa being stamped. It will serve as a temporary GC for up to 1 year.

You may want to do it the other way around- delay the interview a bit to December/ January, then she will have 6 months to use the visa so could come over after her studies are done. n But yes, technically she can come, get the temp greencard stamp in her passport, and leave the next day.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you so much guys. i appreciate your help, i cant wait for her to come here on April or may because i want to meet her that's why i was going to tell her to come here and spend a month or so as soon as she gets her GC.. she can go back to finish her study.

Understandable. But there is no need to wait for a Green Card, as the stamp in her passport is the temporary Green Card for one year and she can travel the next day, as Penguin_ie mentioned. The physical Green card will come in post later.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Thank you Navy, but will there be any kind of trouble for her to get back in to USA with that Stamps on her passport??

Hey S_U....

You need to understand that the I-551 is a TEMPORARY green card, so there are NO issues at all with re-entering the US--REALLY !!!

It sounds like the real issue maybe how long she will be out of the US after receiving her GC. As others have mentioned she can travel with the I-551 stamp in her passport back to India, but now she is a LPR of the USA and must be watchful of the time spent outside the USA so she does not lose her LPR status. So Penguin_ie's advice maybe the best way to go with your situation. In other words do not rush the interview and her arrival into the USA, but hope it is delayed a bit so she can finish her studies without having to worry about being outside the USA too long.

Now i have decided to go Visit her instead :dance:

If you delay the interview till Jan/ Feb, she can delay a little less than 6 months from interview date (Visa generally is valid for 6 months), so can migrate during May vacation and then go back to complete after the summer vacation (will have little less than1 year after that to return). I guess now you know how best to plan - all the best.
