i-864 help need so bad

I am sorry some people here are leading you astray by telling you just do your taxes, and making you be afraid you will get into trouble with the IRS. Don't worry about that. Some of these people are feeding you a lot of garbage. Just go to your tax accountant, tell that person that you want to only declare enough expenses to show your income at the level you need it to be at, and then have your accountant do your taxes, showing the amount of income you need, pay the IRS what you owe them, and then use your IRS form to prove you make the amount of money you need to in order to sponsor your family petitioning them. It is that simple. If you declare too many expenses, showing your income too little, when you are not allowed to use those expenses you could get into trouble, but you will not get into trouble by declaring fewer expenses, showing that you make more income, and the IRS will be very happy to have you do that. Some people declare so many expenses that they risk getting into trouble, but there is no problem with declaring fewer or even no expenses, and telling the IRS that you made lots of money, and then you will have to pay more taxes, but if it helps you to show a higher income to sponsor the people you are petitioning, then maybe it is worth it for you.

Sorry if you took this personally, but what he needed to know is what I told him and that is what he was asking, and I didn't see anyone else answering his question. Yes, you are correct he does need to see a tax pro, and I will agree with you on that. He also needs to know to tell the tax pro that he wants to declare few enough expenses to show the income he needs, and I didn't see you or anyone else telling him that. And yes I hope he listens, and I hope he tells the tax pro to declare few enough expenses to show the income he needs. I read this before on visajourney about what I am suggesting, and I just wanted to share that with the op. I had no desire to steal your thunder. :) :)

That would be bad. That would be saying, i made $33,000 but I only got to put $7,000 of it in my pocket, the other $26,000 went to cover my business expenses. It makes the amount you'll have to pay in taxes low, but it will NOT help you for the I-864.

If your family size is 3, then you need to show you made $23,163, AFTER your expenses. So if you made $33,000, you need no more than ~$9,000 in expenses, otherwise you're not going to qualify for the I-864 on your own and will need a sponsor.

Hopefully you understand this explanation and please take this info with you to a tax professional and have them help you! They need to understand what you need your tax information to reflect so they can help you do it correctly!

Sometimes we assume too much...we were trying to say exactly what dek said, but the OP had to read between the lines, and he doesn't have enough experience with taxes here--none at all from what it seems.

Yes, you will not get in trouble if you underclaim expenses, but might if you oever claim them, so as dek said so clearly, go to an accountant and do exactly as dek said.

And it seems you still had some questions, so perfect's example is even clearer--between the two explanations, if you still don't understand please keep asking, and be specific--tell us exactly what you earned the two years and we can tell you how much income you need for the I-864, and the difference will be the expenses you can claim.

now i got it ...i cam in 2008 but i spend 1 month then go back and come back in 2009 .i can only file 2009 and 2010 .no 2011 ..but the nvs is asking for thee years what should i do ??????

The simple answer is you give them two years and a letter stating that you didn't work in 2008 so you didn't have to file taxes for that year. You're making a simple process too difficult by thinking too much. Relax, take a couple of deep breaths and make an appointment to see a tax professional to get the back taxes filed.

There is plenty of good advice here but let me add a little about taxes. What you pay is not a fixed amount. You have a business so you have business expenses and deductions. My mother had her own business and ended up NEVER paying taxes because of all the deductions she was allowed. Now since you failed to file you may/may not lose those deductions. But get right on it.

Secondly, there are STATE taxes in many places. I am in California and they ramrod you too, and are not as kind as the feds/IRS with tax issues. As a business you may also need a business license in your city or county, and the business may need a tax ID.

You need an accountant.

If you do owe back taxes, and I have been in that position thanks to my accountant not carrying a number when adding and bang, I owed $3k to the feds. Plus penalties. I told the IRS I would pay a certain amount each month, they sent me a paper to sign, and I paid as agreed. Very simple. I owed the state money as a result and they simply took it out of my paychecks. NOT fun.

So remember in addition to paying taxes you have legitimate deductions too which can help alleviate the hit.

1) Do your taxes

2) read the directions for I-864....they are the clearest of any form you will have to fill out

3) Fill in the form

4) Then and only then will you know if you have a shortfall, and if you do, how big it is, and do you have enough assets to cover the shortfall if there is one

5) Stop wasting your time waiting for someone here to tell you what the right answer is

6) DO YOUR TAXES !!!

7) Then and only then can we have a conversation that is meaningful--in the meantime you are wasting your time and our time

As some have said if you don't understand keep asking, and someone will help you to understand. As some have said you can get into serious trouble with the IRS, but if I were you I wouldn't worry a moment about that, because if you have your accountant figure your expenses low, that keeps your income high, and you will qualify to help your family, and the IRS will be very happy with you. It will mean that you will have to pay more taxes, but it will get you where you want to be, income wise. So, there is a lot of good advice here on this site. It is important to get right on to it, and take care of this soon, and you will have nothing to worry about with the IRS, and it will help you be where you want to be with your I-864. The important thing as has been said is for you to know what your income needs to be, then figure out how many expenses you can afford to claim, take that information to your tax accountant, and tell that person, this is what I need. Any tax accountant should be willing to do that for you, and if someone is not, find someone who will do it for you. It is not cheating; you will not get into trouble for doing it that way. You are just blessing Uncle Sam with more of your money, and in return he is going to fix you up with your I-864.

The math example that myperfectflaw wrote in his post is a perfect example of what you should be trying to do. My advice would be to make sure you claim even less that you think you need to, so that you can provide a margin of error, then you would not cut it so close that, you might mistakenly claim too much expense. In this case claiming less and being sure you have enough income showing is better than claiming more and then finding out you are not showing enough income.

Be sure to ask if you need any more clarification.
