Canadian K-1 and I-94

I'm having discussions with my lawyer to prepare for filing Jenni's AOS and asked him what he needed. He never mentioned sending in a copy of the I-94 so I mentioned he would need that too. He responded that he never sent one in for Canadians.

I realize that there is an agreement between Canada and U.S. that doesn't require the I-94 for visits, but a K-1 isn't a "visit". Also the movers say they can't transport anything without receiving a fax copy of the I-94.

So what is the deal? For those that have made your POE did you get a I-94? Has anyone not received one? Can you request one?

I'm confused.

Yes you get a I-94 at POE .

You might really want to consider not wasting money on a lawyer and file your AOS yourself....the guides here a wonderful and it's seriously not difficult! We were so intimidated during our K-1 petition that we used a lawyer and we so regret wasting the money!!

My lawyer said and I quote, "None of my other Canadian K-1s have received one."

hmmm, I did a search and see that some Canadians actually didn't receive one and ended up having to go back to get one.

I guess we need to make sure they stamp one in Jenni's passport in case they forget. Sheesh!

You realize you pay 6$ for the I-94 when you enter on a K-1 so yes you do get one. If you haven't gotten one then you need to go back and get it.

Fire your lawyer because he is lying. Not only do Canadians get them but everyone gets them and they are needed for AOS.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Err, you're supposed to get one at POE. It's this little white card thing that gets stapled in your passport next to your visa. Some K1s may have not received one but if that's the case it was out of error on the part of the border patrol officer.

You don't need a lawyer for AOS (or any other part of that process for that matter) unless you have a super complex case, possibly filled with multiple marriages, fraud, jail time, and children. :lol:

You also need the I-94 to apply for a SSN. It's an important document even if it doesn't look like it! It's the record that shows you activated your visa.

Edit: Also, I brought American money when I made my POE at Toronto Pearson Airport to pay for the I-94, but they just gave it to me and didn't ask for any money. I guess I was lucky? :P

We were leaving secondary at the Bluewater Bridge and I realized they hadn't asked me for the 6$ so I turned back and asked the officer. He just shrugged and said it was on them, but I do absolutely have the I-94 in my passport :)

I'm looking at mine right now... seriously, I'd be reconsidering this lawyer.

It certainly seems like I am teaching the lawyer. I had not known about VJ when we hired him and he handled our petition just fine. Unfortunately I paid him up front back then so we are just letting him take care of it now. :bonk:
