K1 , HOW DOSE IT WORK ?

Hi to all , don't know how to start our story ! I'm moroccan 33 y/o , and the Girl who I'm in love with is from USA 29 y/o , we met online about 2 years ago , since that time we are always in touch , she was planing come to see me in morocco , but she got sick , doctors said to her that she can't travel for long distance , Our Question is :

Can she start to fill I-129 FORM from USA ? i mean dose she need to come to meet me in person in morocco first ? or there are some excepts ? please can anyone inform us if she can do it without traveling ?

The K-1 visa requires that both of you had met at least once within a two year period. You can come to her, or she can come to you, or you can meet in some other place. There is a waiver available, however I heard it is really hard to recieve. While medical condition could qualify the main question will be asked why you can't come to visit. So if you want it to go as smooth as possible make some arrangements to meet with her.

dear friend , thanks for your reply , but it's just i can't get the Visa easily to the USA !! if i could get one then i went to her long time ago , so we asking if a medical condition could be an excuse for her to invite me to the USA then get married or not ?

let her get heathly and then plan a trip.. it would make things easier.. if not.. then MANY PEOPLE would NOT meet and get visas... i don't think the goverment would allow that..

go thru the k1 guide.. then read it over and over.. and then come here and look at this K1 section and learn from others.. it is best way to learn :)

As the previous posted stated, there is a waiver available, but from what I understand they are very rarely granted. She would have to supply strong proof of her medical condition and inability to travel. Is there another place you could meet that would not be too far for her to travel, and that you could more easily get a visa to? If not, I guess you can try to apply for the waiver and see what happens. Good luck to you.

In order to even qualify for the waiver, you'd need to exhaust all the ways you could possibly meet without her traveling to Morocco. Meaning, you'd need to apply for, and be denied a visitor visa, and you'd have to show them that you made attempts to meet in other countries near the US. And her medical papers would have to be tight. Even then, the chances of being granted a waiver are very slim.

If her illness is temporary then you'll never get a waiver for the two year meeting requirement. If her illness is permanent, and she'll never ever be able to travel out of the US, then you've got a good shot at the waiver. As squeaky indicated, you'll have to try to get a B2 visa first and get denied. She'll have to submit a heap of medical evidence to prove she absolutely cannot travel - ever.

You have to meet before you apply. Morocco is the toughest country to get visa's approved. You would be wasting your time, money and energy. Unfortunately your only option is to wait to meet her.

Yes you must meet first and only then file the forms.

It is almost impossible to get K1 visa from Morocco as is. Most people have to go CR1 route. You have 0 chance of getting K1 if you will not meet in person, even with the waiver. Even if you are successful with getting the waiver you will be denied.
