Different Checklist VJ and USCIS

My fiance and I start sort out what do we need to put for I-129F package. He reads the instruction on http://www.uscis.gov...i-129finstr.pdf but quitely different from this http://www.visajourn...content/k1guide. For example, on USCIS website it doesn't say anything about cover letter of I-129F, letter intent to marry, proof of ongoing relationship. Only photographs, biographic information, birth certificate and some documents from him. My question why those are have different list? or maybe we just misunderstood the instructions? Thank you for help.blink.gif

You did not misunderstood, the VJ list is based on 1st hand experience of the members who had gone through the process themselves. USCIS are the minimum, VJ's adds to it to reduce or eliminate the possibility of a RFE. Keep in mind that no one can guarantee approval or no RFE; the VJ list just improves your petition.

For example, the cover letter is basically a list of all what is included in your petition, the idea here is a. ensure you didn't miss anything and b. make life easier for the USCIS person reviewing your case (an index if you will).

The entire goal is to make your petition as easy to review as possible and to avoid RFEs.

You have missed the part in the I-129F instructions which state that you must include a statement of intent to marry, and proof that you have met in person in the last two years. See part 5 in the instructions. It most definitely says something about those things.

The VJ guide does not say you have to submit evidence of ongoing relationship. It says you will need evidence of having met within the last two years and primary proof. And for some countries it may help to frontload the petition. HOwever, the primary evidence of meeting is the requirements.

Cover letter is not a must but it helps you and USCIS to get a better overview.

You have to proof that you're legally free to marry. The easiest way to do that is by writing a sworn statement that you are legally free to marry and intend to do so with your fiance. (5b on instruction for I-129F).

Making two copies of entire package isn't required either but some do it to have a record of what they have submitted.

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Not to worry, everyone gets nervous when so much is at stake.

You want to check and recheck your petition before mailing it. 2-3 times to make sure you have everything completed and also cross check the different forms to ensure it all matches.

Also, once you mail your initial petition, start looking into the next steps (after NOA2, interviews, etc) and past that (AOS). The name of the game here is preparation and knowing ahead of time what you will need because often getting documentation can take days or weeks. Last thing you want is to find out you need that one document that can delay your case by 2-3 weeks.

You don't need to rush but you want to be be a couple of steps ahead; this will save time and $$$ on a process that is already lengthy and costly.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .
