Hello Everybody

My husband is the winner of the DV2011 lottery . We went to the interview on September 13th, it went well and the Consul told us to come back in 2 days. We went back and our visas weren't still ready so we went back again in the following 2 days and they gave us our passports. My husband has his visa in his but they didn't give me mine. They gave me a refusal worksheet with SECTION 212(a)(9) checked. Also I'm the student in the US and still have a valid visa. Can i still go back in the us with my student visa? What should i do ? Has anyone met that case ?

Sounds like maybe you were deported? If so, no you cannot return using the student visa. A few more specifics would lead to better answers.

hello Belinda

No i have never been deported.. i was a full student attending school but I had issue with immigration because i was working in the country but they never deport me I came back for my interview with school approval. Also after that issue with the immigration i came back last year to renew my student visa and they gave it to me, so i went back to pursue my studies with no further problems. so here are all the details i have.

212 A 9 is for aliens who are inadmissible because they were ordered removed from the US. Even if they left on their own, if they were ordered deported this still counts. Did you overstay your visa?

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

No, i didnt overstay my visa . i came back to my country to renew my visa before it expires and my new visa is valid until 2013 also they did not cancel my student visa after refusal of the Dv lotery...
