i was cited back in 2007 for loitering for the purpose of prostitution and misdemeanor battery which was both outright dismissed. is it ok to apply for citizenship.

Yes. I do not know if it will be approved. No one here does.

Step 2: review different case.

Liquor store gets robbed. You are walking the dog a few blocks away. The robber is described by the store clear as somebody who remotely looks like you. Police is checking the neigborhood and arrest you for suspicion or robbery. They find out you were not the bad guy and all charges were dismissed.

Are you now a criminal?

Are you now a person of poor moral character?

Should you not be allowed to become a U.S. citizen?

Step 3: brain processing stage:

If charges are dismissed, that means you were found not guilty of any wrongdoing. Thus, this has no impact on anything.

Step 4: conclusional stage:

Yes, it is okay to apply for citiznenship.

No, it will not have any impact at all.

That is exactly correct. You might have to show the court certified paper to IO at the time of the interview.

Actually you're wrong. Could be dismissed with or without prejudice. Being dismissed doesn't mean innocent, it means they didn't have sufficient evidence to get a conviction at the moment and could come back again (depending on the with or without prejudice part) and USCIS HAVE been known to use an arrest against someone (there was a thread somewhere which I tried to find but couldn't). I think there were other negative factors in the case but regardless it was held against him/her as a negative

They will do that because there will be no crimes anymore since all people have chips implanted and the prosecutors are bored to death.

I was stating that this MAY have an impact on immigration, and that USCIS MIGHT hold it against them, I was not talking about police resurrecting it.

Yes this is accurate. Conviction or not, if you have been arrested or citied for anything, they can take that into consideration based on the citation and determine if citizenship is approved based upon moral grounds.

In situations like this, it may be worth it to get a lawyer for sure. Any arrest or citation over and above a simple speeding/parking ticket can be determining factors on being granted citizenship. If there are any other questions on the application, then this could mean more then you'd think...
