Thanks so much, everybody...I guess it's abit too late to cancel the check so we will just wait and see what's gonna happen to our package. We are going to pay off for our ignorance and carelessness but we definitely would learn from it.

Jan,2008 we met each other for the first time
March 11,2010, I flew to Dallas to visit him. We started dating.
September, 2011, we made the most stupid mistake we could have, sending out packet I-129 application without putting in a single page of supporting document.
January 12,2012, we received our declined petition letter after 5 months :-(
January 20, 2012, I flew to Dallas to prepare the packet and sent out the fiance petition
January 23, 2012, we received our noa1
May 30,2012, we received our noa2
June 13,2012, Our case was forwarded to Montreal
July 4,2012, I received RFE
July 5, 2012, I sent out RFE
July 9,2012, Montreal received my RFE
July 16,2012, I sent out my Packet 3 (I did not call Montreal to confirm if they have sent out my Packet 3)
July 25,2012, I received my Packet 4 in email
September 4,2012 at 9:10 am, visa approved !!!
September 6,2012, Visa in hand
November 17,2012, POE in Chicago
February 09,2013, Wedding

March 16,2013, AOS package sent out

March 22,2013,NOA received.

omg.. i just read the the k1visa guide again.. and i forgot the proof of name change for both of us!!!!!!!!!!!! how did i miss that???? GREAT!!! we'll waste about 2 weeks for RFE..

You will most likely get a RFE which is not always a bad thing. In our, and most of other cases, they will process your application right away after responding it. We responded in few days after getting RFE and got approved in 5 days after that. We were actually waiting for NOA2 for a month later.. so RFE shortened the processing time.

the package was done in a rush and I think i should have been more attentive about it and explained everything to him other than let him do it by himself and then mailed it ASAP!!! I am blaming myself for being a slack during the package prep...thought he could handle the case but... :blush:

Rushing is a bad call and can cause a lot problems and make things take even longer. It's a bad idea behind the wheel, and it's a bad idea here!

As a former Embassy employee I can say that it is the norm to NOT get US government documents right the first time around. A few are perfect, and you have to wonder who 'really' wrote them out. And a few are almost blank, like yours may be. We understand the communication limitations. In the end it will indeed delay the process, but I don't think it'll kill it. Think of it this way -- you are moving slowly, but at least you are moving!

03-03-2011 - Mailed I-129F application.

03-06-2011 - Packet received in Texas.

03-23-2011 - NOA1 received in mail, dated 03-09-2011.

05-31-2011 - RFE requested. They want better passport pictures of me.

06-06-2011 - Additional passport pics sent.

06-08-2011 - Evidence received and acknowledged. Whew!

06-16-2011 - NOA2 received!

07-20-2011 - Packet 3 Received!

01-31-2012 - EAD and AP approved.

02-08-2012 - EAD/AP card received.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

03-01-2012 - Green Card in hand!!!

364 days total time!

He just sent the i-129f package without putting in any evidence documents in it!!!! I will be rejected or there will be another 1 year of waiting??? I cannot believe he made such ridiculous mistakes!

Didn't he read the instructions? Do you think he sabotaged your chances by creating an incomplete petition? I don't know. I would be very disappointed and suspicious, too, if I were in your position. What did he say?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I don't think he did that on purpose to sabotage my chance of coming, if that was the case, he would not have included the check in the package. He said things will work out...

I am just upset about not being attentive myself at that time, if I could have been investing more into the case instead of counting on him finishing the package, everything could have been different.

First, just relax. Its not the end of the world. Second, didn't you two talk about what you needed to do before he sent it? I mean, he is not applying for a drivers license. Lastly, we have a USCIS number of 800-375-5283. They should be able to help you. They seem to be pretty knowledgable. Let us know if we can help with anything else....and just relax.

I might add also, it took us three months to gather all our information and about five hundred double checks to make sure we had everything we needed. I can tell you what we included it and the order we put it in. We basically followed the guide here on VJ and we got approved the first time around. Of course, the guide doesn't give you some of the details that Haidee and I pondered about for a while.

alrighty..folks...I finally called the USCIS this afternoon..they told me that since he did not put any evidence in it, we might get our package back in about 1 month of time with fee and everything...As for those people who got rejected after 5 months, that was after the petitions were sent to the NVC. But in our case, we cannot even pass the USCIS.

I live in Canada, so if that is needed I might fly to the states to process everything with him, this time we will be really careful with the documents we need...

i feel like you should just wait and see what happens. I am sure they will send the letter requesting more evidence, rather than canceling the check or smthing i duno i wld not do that... because they know ppl miss stuff out when gathering everything,,.. try calling the 1-800# and talking to a supervisor maybe not a regular representitve because they give you more misinformation ... from my own experience i called the other day ... i just felt like the girl was sitting on the computer and read everything off so try talking to somebody higher...

I am very upset to see this comment but I have to admit that..yeah I found it the same way about the attitude~ :(

I do not suggest canceling the check. Here is what will happen...

they will accept the case for processing and prepare it the way they do and sometime later, maybe 2-3 weeks, they will get the news that your check has been cabcelled. They WILL NOT reject the case, they will send you a letter (when they get around to it) asking you to send payment and that your case has been suspended until you do. If you do you then have to withdraw the petition. In the meantime you will prepare a new petition and send it in and they will reject THAT one because you already have a "pending" petition. You will open such a can of worms that you will never get the worms back in the can. And save $340. And delay your case many months.

Look, you made a BIG mistake and you need to recover from it. That is all.

IF they reject your case because he forgot something else or even signed the forms in the wrong place...good news.

If they accept the case and you receive an NOA1, then send a withdrawl letter referencing the case number and prepare a new petition, include a COPY of the withdrawl letter in your new petition. It will cost you the lost filing fee. It will be the cheapest, fastest anbd easiest way to do it.

I strongly urge you DO NOT cancel the check.
