K-1 VISA layover at airport outside the US

Hi,

Strange question but a realistic one: if there is a layover for the next flight at an airport other than airport of origin and not in the US for point of entry, can the K-1 VISA holder go outside of the layover airport for a hotel stay, or is this restricted?

Seems like we are from the same country for K-1 visa :)

Unfortunately K-1 visa only entitles you to enter to USA. If you have a layover in Europe which would be common to fly from Ukraine, then you would need a Shengen Visa to get out of the airport. Unless there is an agreement between UA and the country of no visa entry which is not a case for the european country, so you will not be able to leave the airport. If there is an hotel inside the airport and some do have it. If I am not mistaken Charles De Gaulle in Paris is one of them, then you can stay there, other then that you can't.

I would recommend look at the direct flight from Ukraine to US (POE NYC) and then connect to your final destination.

As long as the K1 has a passport and visa for Country here he or she is at on the layover. International airport waiting areas are like a free zone, you are in holding till your next flight. If you leave the airport better be squared away.

PS the most direct flight is the best, maybe not the least expensive.

As Oksana & Max and bigdog have already told you, if you want to leave the layover airport itself, you would need a visa for that country you are laying over in.

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The United States of America could not possibly care less what your fiancee does in another country provided she is not a terrorist or drug dealer, etc. Her issue will be with the country she is in and whether THEY require a visa for a citizen of her country

If she is coming from Ukraine, you can get flights straight through without overnight layovers. We just came back and we arrived "2 hours after we left", same day. I really didn't even know if it was time to sleep, eat...whatever. The return trip has always been worse for me. :lol:
