Utility bills are not big deal, they are considered as secondary documents. The most important "primary" documents would be as follows :

1- IRS Tax Return Transcripts (Jointly Filed) for 2009, 2010 and even 2011 (If you guys have already filed) You can obtain these Transcript Request form is form http://www.irs.gov/pub/irs-pdf/f4506tez.pdf

it is absolutely free & it takes about 2-3 weeks.

2- For your case, the proof that you guys are expecting a baby/babies. It can be your OB/GYN's note with the signature. You can even create this kind of form & have him sign it.

3- Financial co-mingling, joint bank account statements & other financial documents etc... during his 2-year Conditional Residency.

4- House Mortgage / Deed & Car Payments etc...

5- Beneficiary (being your husband) of Your Life Insurance Policy, Your Health Insurance or some sort of Your Retirement Account or Your Pension Account etc......

If you have these documents above, you don't need secondary documents. They are very strong evidences.

IRS tax is the most important document. If you guys have kids together, thats works perfectly great. Furnish them with 3 years of IRS tax papers. If you have life and health insurance those will do as well.

Unfortunately, we got an RFE. After 6 months of hearing nothing, I guess they decided to look over some files.

Here's our problem... I'm the US citizen and everything is in my name (utilities, etc.) because the house and everything was in my name before we got married. I changed my name to his last name and changed it on all the utilities.

Here's my question... do we change/add his name to the utilities? DO I send in information showing proof that my name was changed and therefore names were changed on the utilities?

Also, we have one shared savings account. I make 10x what my spouse makes, and therefore, I pay all the house bills and my bills (my credit cards) he pays some of the house bills and his bills (his credit cards). How do I show financial documents???

I already submitted our Insurance documents that we have through my work that has both of our names on it (they only print the subscriber's name on the insurance cards).

We are currently expecting our first child, so I know that is evidence, but how do I prove that? Letter from the doctor with ultrasound pics included?

I NEVER expected an RFE and now I'm stumped and could use some assistance.

2- I will contact our insurance company, through my work for documents -- even though we are encouraged to print from the website (I already sent this in). But, I will request something from the company directly and send again.

3- We just re-financed our home, but because I bought the home on my own before we were married, the rules for the re-fi was that only I could re-fi under my own name. However, he had to sign off that I was doing this and with his approval (MI state laws). So, I will dig out those documents.

4- We own the cars, so there's nothing there. I already included insurance cards for our cars that show both our names.

5- I will contact my retirement person to see if she can get a formal document stating that he is my beneficiary there, too.

So, with those items, do you all think that would work??

If you own your car do what we did - include a copy of the pink slip showing names and address, you can also include a copy of the renewal of tags slip. It corresponds with the car insurance.

Yes it will work, send as many documents as possible & do not forget to get IRS Tax Transcipts, http://www.irs.gov/p...df/f4506tez.pdf

Also do not send the original of IRS Tax Transcripts, make their photocopies & send them; because you will need them again when you apply for US Citizenship (N-400). Good Luck !...

The only other things I can think of is what if you cross referenced the payments on your husband's credit card statements with the utility bills that were in your name? This will show that while he might not be on the bill itself, he is paying for them. For our application, we also submitted some "official mail" e.g. letters from the Social Security Administration and my husband's jury duty summons - while these may not have both our names on it, they are addressed to the same place. I also included insurance statements showing that my husband was indeed on my plan and was able to use it in addition to the online print outs.

So, I've got...

1- our Tax information, and I guess I didn't include it the FIRST time, because we had submitted it every other time, guess we should have included it anyway. That'll be one of the first things I print out.

2- I will contact our insurance company, through my work for documents -- even though we are encouraged to print from the website (I already sent this in). But, I will request something from the company directly and send again.

3- We just re-financed our home, but because I bought the home on my own before we were married, the rules for the re-fi was that only I could re-fi under my own name. However, he had to sign off that I was doing this and with his approval (MI state laws). So, I will dig out those documents.

4- We own the cars, so there's nothing there. I already included insurance cards for our cars that show both our names.

5- I will contact my retirement person to see if she can get a formal document stating that he is my beneficiary there, too.

So, with those items, do you all think that would work??

Huge sigh of relief. Got the email today and website confirmed card production ordered today March 22. This is so wonderful because now no more deadlines, we can apply for citizenship or not it's our decision and it's so nice to have the pressure completely off. I was getting worried because I was one of the few RFEs. Our RFE came 12-16 but I wasn't able to respond until 1-26. I was beginning to worry that it had been thrown in with the January apps and wouldn't be looked at until much later. They supply a little red RFE envelope but we had way too much stuff for that so used the normal priority mail thingy and just taped the Red RFE address part from the envelope on the outside. I know they receive thousands a day and it would have been so easy for it to get thrown into the January bin instead of the RFE bin. Since the RFE was due in March I was worried we would be getting notice that our app was abandoned and we'd have to start all over again.

I think we got RFE'd for a reasons in case this helps anyone in the future: 1) We do not have children yet... nothing I can do about that... 2) I did not send actual IRS transcripts the first time around but just copies of Turbo Tax Returns with our names on them, I guess not good enough. 3) We had no lease or mortgage signed together. This is because I am a church worker and we have typically been provided with church-owned housing. I didn't explain this or support it the first time around, but sent in the explanation of lack of communal residence evidence with my RFE. As an overkill gesture we sent in a picture of us together from every month we'd been married in front of various landmarks.

My only concluding thought is: If they basically approve everyone why make us go through all this trouble? sigh, at least it's over, many many hours of my life gone, thousands of dollars sent into the US gov't but at least can be with the one I love, It's worth it.

Thanks to all you Visajourniers, I was mostly a lurker over the years, but before I began the K-1 process three and a half years ago I read the Guides voraciously, and lots of forums as well. I read and read and read. Never used a lawyer, never had a hiccup until this RFE. I'm especially impressed with those who remain to answer questions for the newbies even when their process has been over for a long time. You guys are amazing, I can't do it, now that we're done I'll spend very little time here... thanks to you who do post, and help out those who are coming after you.

Blessings all! And to you Vermonters Keep the faith!! It will happen, just not as fast as you'd like. I've searched a lot of these and they basically never deny anyone, as long as you fill out the stuff right. The burden of proof is ON THEM to proove that you do not have a true marriage, They can't do that, so they just string you along and aprove you in the end.
