I got married with US citizenship since 2004,have been living in the US since 2005 ( with my Green Card ), so right now I'm eligible to apply for US citizenship.

I'm trying to to fill out the form N-400. But I'm curious from the question PART 2.

PART 2. Information about your Eligibility ( check only one )

A: I have been a lawful permanent resident in the US for at least 5 years.

B: I have been a lawful permanent resident in the US for at least 3 years

and I have married to and living with the same US citizen for the past 3 years

and my spouse have been a US citizen for the last 3 years.

I have one kid with my husband back in 2008. But in May 2011 my husband and my kid went to my home country and they are not back in the US yet.

I'm wondering if that would be a problem because the answer of B ( my husband and I should living together)

Can anyone help me at this question? Should I pick A or B.

Three year is only offered to applicants married to US citizens and is called a privilege because when married to a US citizen, figure you would make a better citizen in a shorter period. But the price to pay in all that extra evidence to prove that married relationship can be quite heavy. Any married couple can simply wait the standard five year period and skip all that stuff.

Since you already had your green card for over five years now, you would have to apply for the five year. Its far simpler, no tax returns and all that other joint stuff.

Know of a married couple about three years ago when the USCIS was taking 9-12 months from the time you applied to your interview, she applied 90 days before her 3rd green card anniversary and was married 3 1/2 years before her interview. Want more evidence even though she met the requirements and made her wait another 15 months before she finally got her oath letter for another 3 month wait. She was already married over five years before she got her certificate.

Anyway, check A, still have to fill out all that marriage stuff and previous marriage stuff you if had that, but don't need proof of divorces, marriage certificates, and all that other stuff.

If you've been a resident for 5 years, then that is all you need to say... doesn't matter anymore how you got it!

That is all we sent in for my stepdaughter, but did give her a set of tax transcripts for her interview, didn't even want to see those. Would have also given her proof we paid her traffic violation when she was a minor, if I knew about that. But in total contradiction to the instructions.
