Hey VJ folks,

I will be eligible apply for ROC in August, 2012 since my 2-year permanent resident card expires in November, 2012. Now I have two questions:

1. What is average the ROC process time-frame? [being through 2 rounds of paperwork already with USCIS, I understand that each case is different. I'm just wondering what the AVERAGE ROC process time-frame is].

2. The AOS IO who interviewed me and my husband for my AOS interview stamped a page in my passport with: "Upon endorsement, serves as temporary I-551 evidencing permanent residency for one year. Issue date: Nov. 1st, 2010. Valid until: Nov. 1st, 2011".

Obviously, I can't travel within a little over a year before applying for ROC, but does that mean I have to apply for another Travel Permit when I apply for ROC?

Is this the norm with every AOS case? A 2-year-permanent-resident is not allowed to travel out of the country during the second year of permanent residency?

3. I currently hold a job. Do I have to apply for another EAD application with ROC? Do I have to provide any evidence for my employer that I am applying for ROC while I am still in the ROC process?

9/4/12: ROC packet sent
9/8/12: ROC packet delivered to VSC
9/12/12: Check cashed
9/14/12: NOA letter received (NOA dated 9/10/12)
9/20/12: Biometrics letter received (Bio appointment 10/15/12)
10/12/12: Early biometrics walk-in

4/27/13: RFE received

6/17/13: RFE response sent

7/1/13: ROC petition approved

7/5/13: GC received in the mail.

CSC and VCS are processing within a 6 month time frame. One recent CSC filer had hers approved in approximately one month from filing date, while VSC appears to be taking closer to six months. A lot, however, could change in a year.

Your Green Card, which is valid until November 2012 can be used to reenter U.S.A. along with an Egyptian passport. Over this summer, my wife left and entered America on three occasions and had no problems whatsoever. I believe that the temporary I-551 stamp is given, so that one can travel between approval and the time the Green Card is produced.

No EAD necessary as the NOA1 for I-751 serves as a one year extension of your Green Card, allowing you to work and travel.

My passport was stamped from Nov. 2010 till Nov. 2011 though, which probably means I will have to re-apply for another travel permit or make an info-pass appointment to clear the issue. May be it was an IO mistake... But at the time I thought all AOS Filers go through the same thing.

My passport was stamped from Nov. 2010 till Nov. 2011 though, which probably means I will have to re-apply for another travel permit or make an info-pass appointment to clear the issue. May be it was an IO mistake... But at the time I thought all AOS Filers go through the same thing.

You don't have to reapply for a stamp or travel permit. Once you have the greencard, that stamp on your passport is meaningless.

Once you apply for ROC, you'll use your expired greencard and the NOA1 for the I-751, which states that you may travel and continue to work for one year.

Removing Conditions

Sent package to VSC - 8/12/11

NOA1 - 8/16/11

Biometrics - 9/14/11

Once you apply for ROC, you'll use your expired greencard and the NOA1 for the I-751, which states that you may travel and continue to work for one year.

Your Greencard serves as work permission and travel permission. The stamp you got was temporary, intended as proof of residency for the time between interview up to the time your GC came in the mail. Now (and since probably 2 weeks after your interview), your physical GC supercedes that stamp. You can travel after Nov 2011. Most people never get a stamp at all.
