what to file after you get your visa?

I recently passed my interview after 5 hours of waiting :) I am currently waiting for my passport with the visa. What do I need to do next? In terms of filing for permission to work and travel back home.

Please help I think we're going to try to do this without a lawyer.

The process is fairly simple and self explanatory that I wouldn't recommend a lawyer!

Would help if you stated what visa you just obtained.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I just assumed they were talking about K1.

And we all know what Assume does? lol Probably is the k1, but ya never know.

Also when filing for the adjustment of status, does that have to be filed right after marriage? Or can we wait a couple months for that?

You need to take some time and read the guides o the AOS page. You will find the pros/cons of applying for an EAD asap after you enter the USA. II didnt go the k1 route, but I think if one applies for the EAD right away, then gets married, that EAD is void?? I'm sure someone will set you in the right direction over that, But do read over the guides and dont forget up top there is a section on examples of filled out forms.

Not before you've entered the states....you have to enter on your K1 first. Think of it this way - you arrive and you have 90 days to get married....even if you apply for a separate EAD (Employment authorization) immediately you probably won't get it before you get married anyway :) There is nothing fast about anything to do with immigration,You can certainly check out the current processing timelines for EAD.

Some folks decide to have a quickie civil ceremony when they arrive before their planned 'BIG DAY' so that they can get the ball rolling and apply for AOS (Adjustment of status) which includes EAD and AP (travel doc called Advanced Parole).

You will cost yourself more $$$ if you apply for EAD separately and then AOS later. You seem a little unsure of what's next and how it will all work but the guides can be very helpful as Flames notes......

I will ask this question too, as my fiance just entered the US on her K1. When we apply for her adjustment of status, do we NEED to also apply for EAD, or is the EAD automatically included when we apply for her AOS??

I feel like it would be extra money if we apply for them separately....

..so the short of it, is what is included in the adjustment of status? Does it bring the ability to work with it?

The EAD and AP are separate forms, you can file all three together for the AOS fee (I believe it's $1010, but you'll want to confirm that on the form instructions). There really is no point to filing the EAD separately, if you do, there is an additional fee and the EAD becomes void once you get married, which is pretty much useless since you have to be married within 90 days, and the EAD alone could take up to 90 days to process.

You can wait to AOS after you get married, but keep in mind, you can't leave the country or work until you get the EAD/AP, which you would file together with your AOS.

Please read the guides link up top! It will explain everything you need to know in more detail.

Not trying to be rude, please ask all the questions your heart desires. But one really should sit down and read over the guides a few times to ensure your familiar with the process. No 1 cares more about ur case than you!! If one of the VJ members give u wrong info, it does not affect them, it affects you. For the most part people give the correct info, but if you have not spent the time reading the guides, you wouldn't know if the info is correct. I just state that as the Cdn forum is a small group and many times the same question gets asked over and over and over, lol and that's fine, but less people take time to actually look it over as they have seen that question a zillion times,lol Good luck on the AOS portion of the journey!

Speaking as someone who is going through the AOS process right now, I found them to be incredibly helpful when trying to wade through this crazy paperwork!! So... take a deep breath.....and click on the little thing at the top of your screen that says Guides , and also the Example Forms section....and then if you have any questions there are many many friendly helpful people here who will try and give you the right answer! biggrin.gif
