I'm the kind of person who likes to get it done the first time and done right. So I would weigh out my options. And if something caused doubt in my mind, I'd find another option. No one said anything about not trying.

Go ahead and get married, file your paperwork to adjust status. :)

On the subject of a lawyer to do your paperwork:

1. Visit uscis.gov and download the form I-485 AND it's accompanying notes.

2. Read through the notes carefully and see if there are any sections where you have to clarify the situation with additional notes (ie criminal or medical issues that require waivers)

3. Read the Guides at the top of this page to see the recommended evidence to support your application.

Think carefully about a lawyer. Realistically, unless there are significant issues on your application, YOU will be giving the lawyer the information to complete the form, and YOU will be giving the lawyer the evidence to support the application. What's the darned lawyer actually doing for your money, other than completing a form? Seriously? Start saving for your first trip back to Italy as a married woman, or start saving for your childrens' college funds. :)

If OP does AOS then they also need I-130.

The only question I have is whether or not the OP disclosed a bf in the states when applying for a B2 visa, since they are from a VWP country.

I did read the whole thing, thanks. Did you read and see my posts, namely the ones explaining that AOS was a fine route to take and steering the thread in the right direction? My question is still relevant. The OP is from a VW country and got a B2. If they were asked if they had a bf in the states, and said no, it will be a problem. This probably didn't happen, but it is slightly unusual for a VWP country person to have a B2. Just curious about the circumstances of getting the B2. Your attitude is always a delight.

If I'm reading accurately, perhaps Harpa's concern is whether the OP disclosed having a U.S. boyfriend at POE, and whether any suspicion of immigrant intent was noted in the records at POE.

I would like to know why the OP (from a VWP country) needed or decided to use a B2 visa, and specifically what she was asked at POE and how she answered.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's what I was about to ask - where on B2 application you disclose having a boyfriend ? No such question on DS-160.

Cause the VWP allowed you to remain in the country just for 3 months ..if you want to remain more you need the visa process and ask for a B2 .

and no there are no question about , and when i move i was not sure about everything , I also have a letter from him that said that we are friend and he was responsible of my stay in the country , cause we have passions x dogs in common , and we wanted to go together to show dogs..and visiting kennel and breeder .

Yes, I know there are no boyfriend questions on the application. However, I read about a case where the person had a B2 and then applied for AOS. At their B2 interview, they were asked specifically about the person they were visiting. They said "friend" and got the visa. Then when they applied for AOS, they were asked how they met and about the evolution of their relationship. They talked about when they met and fell in love before the B2 visa application. Because the granting of the B2 visa hinged on the fact that the person said they were visiting a friend, and not a boyfriend, they were in trouble because she lied at the interview. Her whole ability to AOS and get in the the country was based on a lie. Had the person said they were visiting a bf they would not have gotten the visa. The IO for their AOS concluded it was a fraudulent relationship.

I find it interesting that a person from a VWP could go into a B2 visa interview, and naturally the CO would say "Well, why do you want to visit for 6 months and not 3? What's the really pressing need for 6 months" and the person would say "to visit my boyfriend!" and they would say sure! If that is what happened, then no problem. But, it looks like the OP has a letter that indicates her bf is a "friend" who is responsible for her stay which she used at her B2 interview. Also, keep in mind that this is the first B2 and on her first stay she maxed out their stay.

It might be a problem, I don't know what was said during the B2 interview. I think it is not for us to determine, but for the OP to consider. And for everyone else reading this, it is not a crime to love an American or even to admit visiting a significant other at POE. Just have to be honest when asked questions.

I had to choose between the two options too! It is a hard choise because I had a friend that got married to her Mexican fiance while she visited and she claims she got her green card in 4 months but I am pretty sure it was not that easy... I was told by another friend that she cant leave the country until everything is done!

I talked to a friend of the family who works for a law firm in the immigration side... I dont know how much they charge but I can tell you that I just sent the I-129F form for the K-1 visa and it is not very difficult! yes it is nervewrecking and stressful but anyone can do it! just pay extra attention and double check the all the papers! This website is great full of examples and support!

I chose to do it the right way because my fiance while Italian lives in the UK and has a 7 year old and god forbid anything happens to her and he not being able to be there.. the relationship as it is is not the best as it is thanks to the mom.
