AOS form and Tax documents

Hi guys,

Im the beneficiary and trying to collect together my wife's tax documents for the AOS package.

She is so useless at this stuff and really hasn't a clue about what form is what. Then me being English I haven't a clue about the tax forms here.

So to recap, what I require form what I understand: My questions in bold

1. Overall tax information... (Copy of federal tax returns with copies of W2s) IRS Tax information - 1 year is required, up to 3 years may help. What form number would this be? is it a 1040?

2. Tax Transcripts, optional but may help

• W-2s and/or 1099s What are W2s? We have W4s are these similar?

• 1040 from most recent tax year. Is this not the overall tax return?

• Pay stubs for current year (6 months should do) Got these fine. only 1 month though

Keep this simple & easy by using the IRS web site to find how to request transcripts for the past 3 years. They are free & the best way to comply. They can be sent by mail or faxed. Can be had at her local IRS office as well. She can request them by phone as well.

W2 or 4 are wage earning statements from employers. 1099 is issued to self employed independent contractors for example.

1040 is the main form used in personal tax filing.

Only one month may draw an RFE to produce more. If more arent possible explain why in a short letter.

It is either IRS Tax Transcripts or Full tax returns filed (1040, W-2s and other forms, if any). So best to get IRS tax Transcripts - use the link to get those and it is free (http://www.irs.gov/individuals/article/0,,id=110571,00.html).

Pay stubs and Employment letter helps in deternmining that the current annual salary mentioned is correct. So 1 month pay stubs are also alright, if you don't have 6 months.

Try to get an employment letter from her employers or a copy of her employment offer.

Check to see if her current annual pay is suffucient - check here for the appropriate one (http://www.uscis.gov/files/form/i-864p.pdf)

Remember to print the Cover sheet with bar code after the AOS fee is paid and the status of the payment is changed to "PAID", which needs to be in the AOS packet (https://ceac.state.gov/CTRAC/Invoice/signon.aspx)

Leave those four blank - "If your total income ....exceeds Federal poverty guidelines.... Skip to part 8".

It is perfectly alright to have zero income in 2008. Yes, show it as zero. Your wife's current income, which is what she is earning now scaled up to annual, is the criterion (meaning if your current pay is bi-monthly, multiply that by 24). This is the most important income that NVC or Consulate will be looking at. Then the past incomes are supporting incomes, hence including IRS Tax transcript or full tax returns for 2009 and 2008 are optional. Throw in an explanation letter as to why she doesn't ahve 2008 income.....and you should be fine.

What I was getting at was the instructions form the IRS showing you were not obligated to file
