when to apply for I-751

Hi,

Can anyone answer my question, please?

My history:

J1 visa student since 06/2003

12/2004 - got married

01/2005 - applied for AOS

12/2005 - AOS interview (Manchester, NH - everything was OK only background check not completed. They promised to submit my name again. After couple of my phone calls I received a letter stating that they were still working on it.

now 09/2006 - it has been almost 2 years (and 90 days) since i applied for Adjustment of Status and I never received my conditional 2year Green Card becouse of the Background Check and I do not know what to do.

Should I apply for I-751 to remove conditons now?

You should find out what happened to your adjustment of status. If AOS is still pending, then you have not yet received lawful permanent resident status.

The good news is that, regardless of the dates when you initially filed paperwork and had an interview, if your marriage is two years old at the time you are eventually granted lawful permanent resident status, then that status will probably be unconditional and there will be no need to ever file an I-751 (unless you're adjusting from a K-1, in which case you may be granted conditional status regardless of the age of the marriage).

If you actually received conditional status, then you would file the I-751 for removal of conditions during the 90 day window prior to the two year anniversary of gaining conditional lawful permanent resident status. Again, the date of filing an application doesn't matter, it's the date status is finally granted that's relevant.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

At this point I would be hoping the AOS gets approved after December.

1. No, you should not apply to remove conditions from your residency, because you haven't been granted residency yet.

2. As someone said above, if I were you, at this point I'd be hoping my AOS wasn't granted until after the two-year anniversary of my marriage.

3. That said, have you considered getting your Congresspeople involved? It seems like it's been nearly a year since you last had any information on your case, is that right?
