Fiance changed work after filing

My fiance changed jobs after filing the package. If you read my other threads I said that my attorney did all the work and sent out the check... supposedly.

It has been 2 months since and haven't received anything from USCIS.

When my fiance went to meet with the lawyer she said that they requested for him to send him job information for his current employer in stating: work address, wages, start of employment, and occupation.

Is this something they would request... especially the wages? He lives in Mexico if that has anything to do with it.

Also if they did request this information and my attorney is being honest, would my name be in the system at USCIS? I contacted them a few days ago and they said it wasn't then a few days later my attorney says they requested this information.

Also how would they know he didn't work at his former job if when we sent the package in it was correct and he was working?

For most cases, USCIS don't look up to the financial records of the petitioner. However if you have any question, you will be able to call the USCIS by yourself and ask them your question. I believe by now you should have the receipt # from the USCIS.

My lawyer asked for my fiances work history at the USCIS stage when we were just filing the petition but they did not ask what his wages were. Maybe your lawyer is just being thorough by adding that extra detail.

But what it seems like to me is that your lawyer hasn't sent in the paperwork yet.. either that or an RFE was issued for work history.. But I can't imagine that your lawyer forgot to fill out an entire section of the G-325 though (which is one of the forms required for filing, it asks about work history for the past 5 years) That would be quite an oversight for someone who makes a living doing this sort of thing.

So I'm still leaning towards-- your lawyer hasn't filed your petition yet and is still gathering the information to complete the forms, especially since you are not showing up in the USCIS system. You should have received an NOA1 within a week or two that has your USCIS case number, which you could use to track your progress with USCIS.

Are you working with a lawyer from the US or Mexico and do you really need to work with a lawyer? Unless your case has some complications I'd say just get rid of the lawyer and use VisaJourney. After finding this website I realized how incompetent my lawyer was and although I didn't stop using him, I was able to find and fix a lot of mistakes that he had made. By the time we got to the consulate step I was filling out the paperwork by myself rather than having him do it.

At the very least you or your fiance, if the lawyer is in Mexico, should find out what's going on. Has the petition been sent out? If so, where is the NOA1? And if they are requesting additional information there should be an actual request in writing from USCIS. Ask the lawyer for these documents and if the lawyer doesn't have them I think it'd be pretty obvious that they are lying to you and the petition hasn't been filed yet.
