I am from London, England, I have been in a relationship with a girl for over a year now. Since we originally met, we have met up twice since. We are now looking to get married and was just wondering the best process (I will be residing in the States)? We both speak English and are of similar age. She is not on a great salary though but has a wealthy father who is for the marriage.

Do we need to hire a marriage attorney? What is the best way to be with eachother as early as possible?

Any help would be greatly appreciated as I hear a lot of conflicting views and two year waiting lists.....

Regards,

Slev

You do not need an attorney. Just follow guides here. I recommend K1 fiance visa. Fastest.

Review the processes for both a fiance and spouse visa. This may have an impact on your marriage decision (now vs. later)

You can find the information in the Guides section as well as the K1 and IR1/CR1 forums here on VJ

Slev, I'm going to take a long-shot putting together paragraph #1 of this post: I'm going to presume your a United States Citizen (even though from England) and wish to petition for a woman overseas. If this is the case: Her salary, income and/or that of her fathers will have no bearing on the Petition. They will only look at yours alone no matter Fiancee/Spousal Visa Approval.

You do not need a Marridge Attorney (that is for Prenups) I think you mean: Immigration Attorney.

The fastest way to get together seems a Finance (K-1) but if you look at recent trends they are close together as far as timelines. (Spousal Visa)

The need for an Attorney maybe required if there are issues of Criminal Background issues and therefore, such related.

An Attorney may also be helpful if you find the process overwhelming and fell you need help as I did at first.

Lastly, horror stories of 2 years waiting are non existant unless the case is overly complecated.

If your the USC and want to get married and meet the Qualifications to lawfully Petition. JUST GO MARRY HER. Up to You.

Hey Tim, she is the US citizen and I am the foreigner. I was thinking the best method would be for her to file for a K-1 visa. There are no criminal records but as I previously stated her salary is low and savings are low too but her dad is willing to financially support her through this.

Tim/Mav, sorry for the questions, but when my partner (the American Citizen) applies for the K-1 I guess I am not allowed in the US whilst this is being processed? Ideally I was just going to fly out in a couple of months, get married and try to stay out there, is this possible? Again many thanks.

DON'T DO IT. If an Application exists for a K-1 Petition and you enter the US such as a Visitors Visa and/or any other purpose you will be banned for life from the US for Life. Thats Fraud.

if you come to the states and get married there is a waiting period before you can apply for a visa. if you do the fiance visa then you can get married and do what is called AOS for a green card to stay. her father can co sponsor her petition and u should be fine. just remember the waiting is a pain and very frustrating for some. if you use the guide as most of us have you should have no problems with submitting all the forms.
