hhmmm....... I have an RFE received date of July 28th. That means I've been waiting for 47 days for a decision. I've noticed a lot of fast approvals from VSC. I noticed that almost no other petitioners have been waiting for as long as I have from VSC.

So... I figured I was in name checks, right? I mean, who really knows!! but it sounded good to me. I figured I would have some type of extensive look into my history having answered yes to convictions on the I-129f. Well as you may know I called VSC on Monday to see if I was in name checks. The lady said that I was not in name checks and that my case was with an adjudicating officer. She also said that they do not do certain types of extensive name checks unless something else is found. I never asked if I already went through name checks though, I wish I would have. I've read that the IBIS is pretty much an instant check. If they need more they can do an FBI name check which usually takes 2-4 weeks to complete, others under 6 months, and a few who take longer.

Ok, so here's the kicker. I'm with an adjudicating officer. GREAT!! right? but the officer is the one who runs the IBIS background check. I would think that this is when they would find something else, or find the convictions. Then they would probably request the FBI check for further investigation. I mean, is this the first time an officer has my petition? I wouldn't think so knowing VSC and the 47 days since they've had my RFE, or is this the 2nd or whatever.

So, I'm really hoping since I've been waiting for 47 days, and most petitioners from VSC have already been approved, that I've gone though and come back from name checks. Now my case is with an adjudication officer to make a decision. OR! I'm with an adjudicating officer for the first time who is getting ready to put me through IBIS and then put me in further name checks. Then the wait would have just begun. Arrgg!!

This is where my mind is right now! crazy isn't it??

and I know I need to have peace of mind, and trust me, I do.... a little!! I'm going to Poland in October and Ania is aware that we need to wait. It's just that they gave me hope that it could be soon, and this made it worse.

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

Didn't she tell you that you weren't with name checks? Did you assume you were even when she said no because you are paranoid or that your case is with the adjudicating officer that handles name checks?

Paranoid? yes! but also because she said I'm not in name checks. That could mean, not yet in name checks.

You could call again and ask explicitly whether your name checks are complete.

That's true, I could. The only problem with that is the fact that it's very rare you get a person on the phone who has the time of day for you. I think it might serve me better to wait until the 60 days are up for the RFE. (It still says to wait 60 days after RFE receipt to call VSC in the phone prompts) on September 28th. This way I'm not p!ss!ng anyone off, and they'll be more willing to answer my questions, I hope.

There is nothing wrong with your thinking . I think this is very normal for someone who has been waiting and seeing others get approved and you have absolutely no clue what is happening with your case. Talk about a dangerous process !

Hang tight. Keep praying. That's the only piece of advise I can give you. (F)

Perhaps someone can answer your questions...anyone????

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I don't know what I'm exactly looking for. I think I'm more or less looking for someone to tell me what I want to hear, and that can only come from one place...........USCIS.

What more can you possibly do that has'nt already been done? Try to focus on your trip in October, think of your sweetheart falling into your arms and let your troubles melt away while you are in her company.

I'am sure your answer is on its way. Be positive ( I know it is easier said than done ), start by forming a mental picture of that day when you receive your answer from USCIS. Just know you are not alone in this maddening charade.

Remember what often happens here- approvals come when you least expect them. It could be just around the corner for you. I know for me I can imagine every scenario in the world and none ever materialize. If your petition its a name check snag, then you can take come action. For now just hang in there (YES it is so hard!) and know we are all here wishing you a quick approval! (F)

Andy,

try and remain calm I know it is hard to do. Our emotions have been going up in down since we started the process. We had our hopes and plains shattered time and time again as we watch everyone being approved and we are still waiting, and again yesterday and today we see some touches, but don’t know what is going to happen yet. Our hope are up again, but I tell you the truth I am scared as hell right now till I see the approval. Just try and relax and stay calm the best you can. Everything is going to work out.

P.S. I may be here tomorrow crying and complaining again. But I pray I am here jumping for joy. :D

Stop analyzing.

You are too worried about the lightning quick approvals coming out of VSC and yet, you are not approved.

You just hit 62 days for cripes sake. Relax man!!!! Try 150 days or more!! That is he!! on wheels. trust me.

I lived with my Fiance for 3 years and we just surpassed 1 year apart. Survival is communication, we talk for at least 1 hour, every single day.

Your issues are not issues for the K-1.

Be a little bit patient and you will get your approval.

Your right William33! and I know I need to be patient. Trust me, you know I've driven that one home on here time and time again.

But see, me and you are different. 150 days, there was a distinct reason for that and everyone was going through the same thing. Everyone knew why it was taking so long, you were waiting for IMBRA to run it's course. 150 days was common for your filing date and it wasn't an isolated case, it was the entire k-1 community that shut down. Doesn't make it any easier to deal with, just gives you reason.

I'm a little different. The wait I have is not common for VSC at the present time. I am one of few still waiting. I looked at the timelines on this site and discovered that almost everyone who filed before, during, and after me have been approved.

It just makes me paranoid and worried. I'm a natural worry wart!! and that doesn't help.

I will relax, I know I'm a bit of a hypocrite at the present time. I just know that I'm not a super clean petition and that worries me a little. I hope your right about the issues not being k-1 issues. I'm calmed down now. Everyone has helped so much. Thanks.
