Halo

It seems a great family site here.

i am glad i have your support and experience to pull me through.

I am a single never married woman with two children

I am a carrier of the immune deficiency syndrome

I had got my USA Visa and had traveled a couple of times before my trip some 8 years ago when i arrived at the point of entry and was removed with no convincing reason.

I was 7 months gone in my pregnancy and just assumed like they stated i was at risk of having my baby there. A form 1-877 was filled out while the officer signed off a form 1-275 of which i signed off the first two pages n refused signing the 3rd as i had been portrayed as being physically aggressive to the officer which wasn't true.

So i came back had my child and applied to renew my visa in 2004 which was declined on the basis of not having sufficient ties to Nigeria. I found that strange as the circumstances of my getting it the first time had not changed but only gotten better.

However ignorant me; i had a second child and applied in 2006 - i was sure i was to be granted until the officer checked something on his system and decided in their records i was married and again declined on basis of inadequate links to nigeria.

Since then i havent bothered but my children are growing and so much want to meet with the rest of my relaives.While toying with the idea of re-approaching the embassy i keyed in the figures stamped on the visa as per my heading and i feel i had been denied entry based on medical grounds and they just wont come out and tell me.

Given the lifting of the ban on health grounds for inadmissibility - i am wondering who can advise me on how to go about it this time with a positive result.Its been difficult getting legal representation due to disclosure of my health status,discrimination against my children and for job security as such i cant approach any lawyer in Nigeria to advice and handle my case.

Searching VJ here is why you were denied: 212(a) (7) (i)

It seems that your were refused entry initially because they suspected your were planning to give birth in the US and remain (unlawful Immigrant Intent).

The second denial was probably because one you've been refused entry for this reason it is technically like being deported and requires a waiver.

If I remember correctly you can't get such a waiver for non-immigrant visas which would explain why the Embassy didn't inform you of the need for a waiver.

Couple months ago VJ member posted same question and got same answer. Came back couple weeks later and said it took two weeks to get the waiver approved and pick up the VISA.. I am too lazy to dig it up but its in this section.
