Wait for name change before NBI / Medical?

Hi!

My wife (in the Philippines) is changing her name to mine, and will order a new passport. I turned in our I-130 etc in her new married name.

Does her NBI and medical clearance need to be in her new name? Does she need to wait for her passport before proceeding?

You just filed your I-130 the medical is much latter in the process along with the NBI clearance, you have the time so change her passport with new last name now.

All right, thanks. We'll do that. Once we have the passport, is there any reason to wait on the NBI clearance or medical, or should we get them done right away? It seems like the road to the interview in the Philippines is (relative to other countries) short.

What we did was right after the NOA2 my wife did the medical. You will have a bit of a wait for the NVC portion. We got all clearances done after the NOA2 so it would be fairly current to send with the DS-230 package. You cant do the medical unless you you at least have a NVC case number. As soon as you get that number, then have her do the advanced medical. By that time she will have her new passport and name change will be complete.

When she does the NBI..she will need her married and maiden name on it...it looks funny and has a "de" between maiden and married names.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

FYI, your wife cannot amend her (maiden name) passport without the CFO certificate. She will be advised by DFA to attend the counselling first in order to have the said certification.

<BR><BR>You're welcome! I found out about the CFO thing right at the DFA office. I had no idea about it until I went and was told to "attend the seminar first, then come back and bring the certificate". Edited by ~happyndinlove~

Interesting, back in 2007 my wife was able to change her passport (maiden name) with out the CFO seminar first.

I got one question maybe u can share some of your insights. Me and my husband applied for i130 and i already have noa2 and we ar e waiting for case number from nvc tomorrow tuesday... We filed the all our papers under my maiden name will that be a problem? and my passport and all my documents are under my maiden name.... any violent reactions?

I also have issues on my Wife's name. But NVC rep told me it's fixable. All i have to do is just send a photocopy of her biographic passport and they will fix it. Also, once you file for IV (Immigrant Visa - DS-230) You should follow the name it says on the passport she's going to use to travel abroad... Edited by rhenzhen

I just want to confirm, so, it means, ANYONE who will travel abroad requires to get a CFO now? I'm on a CR-1spouse Visa... I really never heard of this...

Interesting, back in 2007 my wife was able to change her passport (maiden name) with out the CFO seminar first.

I'm not sure when the DFA changed that policy but, it seems that everyone who is married to a foreigner requires to do the seminar, first.

As above poster said, you can fix it long as you present your MC... and, be sure that you'll be using a match passport when you travel.

Yes. You can't depart PI without it.
