Chances are likely (humanitarian grounds). Make your request after you receive your NOA1 and have evidence of what is happening ready to accompany your request. You don't need a lawyer to make an expedite request (whether or not you retain one is up to you).

hi. I filed my wife's I-130 petition last month. (i 130 for spouse of US citizen). I want to file a request for expedite on humanitarian grounds. there is major civil stife where is she; the newspapers are filled with dozens of deaths including 85 innocent people dying in the last 48 hours and signs of things getting worse unfortunately. Should I call for expedite or a mail a letter to the service center with the supporting details?

Call and tell them you are requesting expedite on the grounds you are using. Have your proof ready. Ask them if you can fax it to them. You might be able to fax the proof with your letter requesting expedite. If not they will send you a letter requesting evidence for expedite which you would respond to with all your papers that you have prepped.

Now that you've submitted the I-130, is impossible to have any expedite request received via postal mail,

for USCIS to act on it.

Your casefile is in a long queue.

Call USCIS, get a Tier 2 human, inquire for their process, and follow it exactly.

We did this during the Karachi violence in the streets when ppl were targeting anybody men, women and children. My husband couldnt get public transportation to work cos of all the bus burnings and it became extremely dangerous for him especially bocos he worked nights and somtimes had to walk home in areas where killings had just happened.

We called talked to tier 2. Told them we wanted expedite for humanitarian reasons as well as citing the travel warnings listed on the us government sites as the reason for the expedite. Gave them my email address and some more info. I thought they would have requested proof so i had some pdf files prepared to send. However, within a few days we got an approval saying our expedite has been approved and they were pulling our file for review. We had approval within 3 weeks of expedite. (they never asked us to send any pdf info that may be because i cited the travel warnings idk but we were prepared in any case to send)

Once you call and request they give you a reference number for your expedite. I'm sure you will get it.. the area is really dangerous and its getting worse. We completed our interview so we are in ap awaiting the visa... just praying daily that he stays safe and the visa is issued as soon as possible. Inshallah....

Hope that helps!

Highly likely... do as darnell and ryan are suggesting... you dont need a lawyer.. just a phone and a pen and paper to write down the info they give you. You give them your email address and they give you a reference number. You apply under humanitarian reasons and explain to them why...im sure there are travel warnings listed on the official gov site. You can tell them about that and prepare any other proof in case they request in writing. I didnt do anything but put in a phone call and got our i 130 approved within a few weeks. (this was last March during the last round of big violence in karachi)

ANd yes do what Ryan and Darnell are telling you...since you haven't updated your timeline we aren't sure if you have already filed and received your noa1. IF you haven't then file with the expedite request and proof inside the pkg as well as writing in red letters as darnell suggested.

If you have your noa1 already call and talk to tier2 rep and tell them you need expedite for your spouse...

Good luck and i pray everyone stays safe....

So many on here have the same issue. My gf had fiancee working in building next to the bomb in Marrackeh market when it exploded. I wish you good luck but this is a concern for so many trying to leave a dangerous area, I don't see how USCIS can approve all requests. Along with treats of death and bodily harm, there is familne and serious plaques. Can you imagine the US trying to bring all here from Hati. They still suffer greatly and in an emergency bill USCIS provided tempory visa to thousands from there. That is one reason the visa process slowed down for the rest of us. Anyway, good luck, see a lwayer and be able to prove the financee is in personal danger.

OP, while seeing a lawyer is your choice, it's not necessary for the purpose of requesting an expedite.

I can't emphasize, enough, to make that phone call (after you have NOA-1 in hand)

and make the request from a Tier 2 human

and then (this is the important bit)

follow their instructions exactly.

Process for expedite requests vary, based on many factors. Follow exactly what you are told to do, that 'revealed process' will be the one that works for you.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
