Renewing Green Card issue

My MIL had to renew her GC back in Oct last year. I went with her to the ASC to get her biometrics done, and they did them several times until they got a good set. Yesterday she recieved a notice in the mail saying that they had scheduled her a 2nd appointment to have biometrics done and that the fist one were deemed unclassifiable.

She never recieved a notice for the 2nd appointment so obviously did not go to it.

So she has now been denied due to abandoment, and the only way they said that she can do anything about this is to file a I-290B and pay $630. Is there anything she can do without having to pay this fee as she does not have that money.

Is this something she needs to make an infopass appt for?

It is certainly worth making an infopass appointment and seeing if they will re-open the application without having to file to re-open. If there is any way she can prove she never received the second appointment notice (have someone check in her physical file to see if the 'returned' notice is there - that is the best way to prove it), she may be able to argue successfully that she never received the second notice and as 2nd biometrics are not a usual occurrence, she had no reason to expect a 2nd appointment letter. If that is not successful, then have her contact her Senator's or Representative's office and ask them if they can intervene on her behalf. It was through no fault of her own that she did not make the second appointment - the trick is finding a way to show it so that USCIS accepts that situation and re-opens the file without requiring the request. (It could be either the post office or USCIS that were at fault). Good luck.

Thanks Kathryn. I already suggested she contact the congressmans office since they helped me out when I was having issues. The office is right around the corner from her home so she is going there on Monday. I told her to also call uscis and speak to a tier 2 person.

The nearest uscis office for an infopass is in Memphis....6 hrs away :(

It is sad that for all we have to pay for the immigration process important documents such as these are just sent regular mail.

Yeah, this one has always astounded me - that even green cards are sent regular mail and not priority at the very least. With something so theft-worthy as a green card they take little measures to prevent them from being 'lost' and untraceable.

Good luck to your MIL. 6 hours is a heck of a long drive so hopefully the Congressman or Senator can help.
