Pls quick question about those that applied for K1 Visa, had interview and placed on AP.....

What if you apply for the withdrawal of the k1, get married and file for k1, if the reason is that there is no bona fide evidence of relationship, instead of waiting 4, 5, 6 months????????

You'll have to start all over again, the fees, the paperwork and the wait

Getting married doesn't erase the results of the interview, begin working on hwo you can prove a bonafide relationship if that is what the CO is worried about

if your married you can't file k-1 visa, thats for fiance'e 1-129f if approval you have 6 months ,and once in the us you have three months to get married, or get deported back...if you get married file 1-130 cr-1 you get green card and social serurity card soon after arriving in the united states,....if you withdrew the k-1 you lost your money no refunds.you start all over with the 1-130, back of the line.

Yep u could withdraw and get married if u dont mind starting over.....also keep in mind this is Lagos and they are tough.....goodluck

Ok, yes, the bottom line is that you can withdraw and file for k3, spouse visa.....so why do I read here on VJ and people complain of been put on AP for months and years, isnt it advisable to get married and sort out the issues of removal, becos to my understanding, most of the refusal is proving bona fide relationship....

I mean it doesnt make sense waiting, forget the money and time, one could even waste more time waiting on AP to be denied again!!!!!!:wacko: :wacko: :unsure:

there are several reasons of AP n not jus proof of relationship ... if u dont have enough proof of relationship then start collecting now onwards .. the most important thing is WHY a person is kept in AP?? .. and there is no way you can find THAT out Unless there are Some missing docs ...according to the department of state most of the AP CASES ARE SORTED OUT WITHIN 60 DAYS OF INTERVIEW . but some take months n a SOME years .. and there is no guarantee that withdrawing the k1 petition n filing for spousal visa will end the chances of your visa application going into AP .

The mere fact of getting married still does not provide any extra evidence of a bona fide relationship. The Embassy will know these facts and in fact may drill down deeper to determine if there is a legit relationship. If you have concerns about that and if denied the K-1 for those reasons, the better plan would be to wait a few months and build solid evidence of a real relationshp and then get married and follow that path.

If you have already waited through the process of the interview and are on AP the only thing getting married now does is add about a year to your wait. If you are tagged for AP killing the K1 kills the investigation so next year when the CR1 hits you have another interview and get put in AP again. Many nigerian men are getting AP , the chances for AP go up if you are from the north. K3's are normally killed by NVC so you would end up on a CR1 , you would have to pay for the new petition, new medical, new police certificate.

This will not be over quickly. You will not enjoy this.

I advice that you save the money on refiling and spend it on a visit to be with your fiance, which adds to solid proof of a genuine relationship. If you withdraw the K1 and file a CR1 it will take you another year or longer when you have the chance to be out of AP in under that time frame.As said before he will likely be put in AP all over again on a CR1. I would not switch horses in midstream. Just my opinion.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Having a CR-1 doesn't mean the beneficiary would not be put in AP if the CO believes something more credible is needed to be established. So if i were u, i wouldn't bother cancelling the K-1, instead, i'll strive to get more evidence in proving a bonafide relationship, so to speak.

To the OP,

You should stick to ur K1 because you won't knw if you'd be placed on AP even when you change course to CR-1.
