This Morning I got an email from Kingston embassy the email read:

Dear Madam

This case file is still under administrative processing. As soon as a decision is made we will contact the applicant.

I called DOS and they said the case is Temporarily denied and they are reviewing it. She also stated that the case was still in Kingston and has not been sent back to USCIS.

I would just like to know if anyone has been in AP and what was the out come of the case? Also how long could we be in AP?

I'm confused because before they were telling me that my fiancé was denied and the case was sent back to USCIS and they would contact me in 120 days after they receive it.

wow! well an ap is better than a denial right? it think this is good news kay...as i understand it tho an ap can take up to 6 months (that's what i've read on here) but it could take less time...i mean there cant b that many jamaican's on ap right?and if i understand correctly its the embassy that does the additional processing (not sure abt this)...

can somebody say if at the end of ap there will be another interview??

if so then kay u have to find out exactly what went wrong and what ur fiance said to get them in a frenzy...

goodluck girlie,the light at the end of the tunnel is not a train coming afterall :)...hang in there it could all be over soon!

YES, AP is better than a denial. AP could take as little as 2 weeks to as long as 1 year. But for Jamaica, never heard of a year AP.

All denial must be reviwed by SUP before sent back to USCIS, Sup probably didn't warrant a straight out denial.

Yes, another interview could be warranted, so documenation is important.

Email Kingston again and ask?

we were in AP for a year in santo domingo, but we did not have an interview after it was done. Maybe jamaica is less time.

Timeline

After a visa application denied by interviewing CO, a senior officer review the decision to make sure that everything is done according to the procedure. Most of the time, this process takes days or a week. It is hard to tell the senior officer couldn't turn the previous decision, but still there will be a chance or they could ask more things to submit. Get your Senator involved while the embassy is still doing the AP. You have to work hard to stop the embassy from sending the petition back to US. If they send it back to US, then you have a minimal chance of this petition working. You have to use every possible means to convince the embassy and overturn their decision.

My husband had his interview on May 13th in Kingston and didn't receive his Visa. He wasn't given a denial form or anything. He was simply told that the paperwork was being sent back to USCIS and that they would contact me to see if I wished to continue with the process. I immediately called Kingston after his interview to see if I could get information pertaining to what happened in the interview. No one there would speak with me or offer any kind of explanation. I emailed Kingston 2 different times. Finally 8 days later I received an email from Kingston stating the paperwork was being sent back to USCIS for further review. USCIS just sent me a letter ( I-797C, Notice of Action) today stating they received the paperwork on June 29th. I have called numerous times to USCIS. All they will tell me is that they will contact me when the review is over or if they need something from me. They also stated that it could possibly take up to 120 days. I know exactly how you feel, this is terrible for anyone to have to go through.

Kay was this from the 2nd or 4th request email?

I only sent them one email but I sent it on the 23 of June and just got a response. AP for a year I hope not. I have the congressman involved but haven't yet gotten the senator involved I will try to get them involved tomorrow. I’m also going to send them another email with an attachment from my congressman.

Don't let them know that your Congressman is involved yet, because they will stop responding to you and only respond to your congressman. It usually take 5 days for a reponds. Send them another to verify if you are in deed in AP.

This is interesting (while confusing). Hopefully, after reviewing the information they will see that your information and evidence warranted an approval. I also agree you should include information about your upcoming interview. AP is a step up form flat out denial (in my opinion). So hopefully it can work from there. Be blessed.

I am new to this forum but would like to share my experience which is somewhat similar I need HELP !!!! MY interview with my fiance was on July 27, 2011

Make a long story short we were approved we have been together since 2002 we have 9 years together and I have since finished college and am a school teacher.

My father and his father grew up together and I stay for months at a time at our home in the Dominican Republic we are truly in love !! The consular told me you are approved BUT the petition will expire soon. I began to cry and my fiance was calming me down while all the people were staring at me at the window. She told us that we would have to file once again for the petition, I said WHAT??? isnt there anything you can do. She turned the mic off and asked two supervisors and they spoke. She told me ok I can give it to you but you have to wait under ADMINISTRATIVE PROCESSING, she kept his passport and gave us the ticket to pay DOMEX but its been 2 weeks and nothing has happend the petition expired August 6. how is it my fault ??? the interview they gave it to us late.... I dont understand, I call and called the 7 dollars for the pin and they told me to call back in OCTOBER!!!!!???!!! I started to cry what is going on??? I just found out i am PREGNANT and I want to be with him as soon as possible at least before the summer ends. I did everything I paid so much money to get my papers filled out everything right and I still have to go through this??? Please help has anyone else been through this.... She was gonna fill out a green slip and give it to me but she said OH you dont even need this go pay! We are going to do Administrative processing.... please help!

I don't understand, you WERE approved, but your petition expired...?? I don't understand how this could happen!?

Once you have been approved, you have 6 months... then it will expire! Did your 6 months expire??

october to august it did indeed expire the notice of action only because they gave me the interview at that time for july 26 and he was approved that same day and it would've expired august 6 ... why didnt he get it?
