Heart broken, case returned to USA after 2 interviews

Hi,

I would like to know, because it seems that there are three of you who have CR-1 Petitions, how long it was from meeting each other to when you got married? I saw that for one of you it was 8 months, and on the first visit. How about the others?

along a similar vein.

How long from first meeting until marriage.

How long did you know each other before first meeting.

How many times did you meet.

Do you share a common religion.

Is there an age difference and who is older.

How did you meet.

Has the beneficiary applied for any type of visa to the US before.

These are the kind of questions we would need to know to be able to help you identify the red flags that caused the CO to think it is not a bona fide marriage. I think over the past year, these have been the most common tripping points for MENA countries.

I agree wholeheartily with this statement. People tend to forget that immigration isnt a right. Just like driving isnt a right. If you really want to be together, and the US consulate isnt approving of this move, why dont you as the USC move to your partners country and try that route.

I know for my husband and I, we talked about whom would move to whom. We wanted to be together, where wasnt an issue. We both knew going into this process that if for some reason I wasnt permitted to move to the USA, then we would go the spousal route and bring him up to Canada. I think that all couples should have this conversation and try to be prepared for anything with a back up plan or two. :)

We had similar conversations and it made the most sense for her to try to come to the US, but we both agreed that if we were denied then I would move to China. As the saying goes, Have a plan, Stick to the plan, Be prepared for the plan not to work.

Ok, just got off the phone with my hubby, he had his second interview today, and guess what? He got DENIED the CO said he does not believe our relationship is real, so he is returning the case to USA. What do I do? Please help

Live in Morroco for awhile. Get drunk and locked up in the local drunk tank as often as you can, and then call US Citizens Assistance service at the Embassy to come get you out. After about 2-3 months of getting up at 3am to go get you out, they will be happy to approve his VISA just to get rid of you :)

We meet face to face 16 months after we started our relationship, we married then. We've been married for 1 year and 3 months.

We skyped for 16 months before our first meeting face to face. I went to morocco and married him 16 monhts after we first talked. Me only spent 10 days together. We do not have the same religion. I am 6 year older than him. We meet on tagged.com And no he has not applied for any kind of visas before.

Your husband should have asked the CO:Was he asking for the date u first met online or the date u met in person.IMO,this is what causes confusion and the CO thinks ur hubby is not equipped well.

Sorry to burst your bubble, but lawyer cannot do anything he cannot challenge CO's decision, if CO thinks the relation is not real lawyer cannot do a thing about it.

The only thing OP could had done was ask for a translator at the point of interview.

I am not amazed your case was NOT approved.

Red flags:

- Fist face-to-face meeting lasts 10 days during which you get married

- Met online

- Difference in ages (woman being older)

- Difference in religion

Have you only seen your husband ONE time in your life? I mean, this would be pretty strange in any Embassy, but particularly in one high in fraud as Casablanca. As others have suggested, you could move in with your husband and live together as you wait for the case to be returned and evaluated by USCIS. Basically, build a marriage and live together in order to fight back at the Embassy at a later date.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

We were denied a visa many years ago. It took over a year after the denial to get him here. He has now been here 4 1/2 years. It isn't an easy road however.

Most cases are returned, but a few have been successful in getting them to give a second chance. You have to act quick and get a congressman or senator involved and willing to assist you.

Hang in there and take it a day at a time.

LOL, it would be equally dumb if I say "what do you expect from a dumb...... ". And how is line 1 could be a problem if you or the otherone who made a statement ever heard of the term called "Love at first sight"??

I think it's humane if we don't say something derogatory, or demoralizing to people if we don't have an answer, especially when these people are in serious trouble and is looking for comfort and help. We don't really know much about a case and shouldn't make statements like "I am not amazed.....".
