Argueing with my fiance about this form

I already asked this before, its about the question 8 of form I-134.

My question was if we state my fiances kids as PARTIALLY or WHOLLY DEPENDANT and someone told me that they are "wholly dependant" that partially dependant does not apply to K1 visas..

So i just told my fiance this and he says NO my kids are PARTIALLY DEPENDANT because they dont live with me,and i dont claim them on my taxes i paid child support.

So here i ask again what do we answer in the question number 8 of the form I-134 if my fiances kids do not live with him..

You list all kids, even those that DOES NOT LIVE WITH HIM. THE QUESTION DOESN'T STATE "ONLY THOSE THAT RESIDE WITH YOU", it say list all kids.

LIFE´S JOURNEY ..We know that my fiance kids are dependant of him and we will put write their names in the form as dependant of him, we are counting them in his household, but our question is when we list them on the question 8, what box we check the one that says¨"PARTIALLY " or the one that says "WHOLLY DEPENDANT".

It is your decision. As for me, if they have some sort of income and still live with him, I will consider them as partial or otherwise they will be consider as whole dependat.

Being that the 864 form (a link was provided) does explain this and those who want to read, I just leave them to the debate/opinions of those who will follow and post. :innocent:

I'm pretty sure the answer is "wholly dependent" regardless of if the child lives with your fiance, regardless of if your fiance pays child support, regardless of if he hasn't seen the child since birth. If it's his kid... for visa purposes it is a wholly dependent child regardless of any circumstances. Like I said, I'm 99% sure of this. The experts will chime in.

I'm think that it probably doesn't matter. That is, if you check "partially dependent" but actually all children are considered "wholly dependent" then the powers-that-be will just automatically count them as wholly dependent regardless of what you wrote.

I think it's also not really relevant as the I-864 doesn't distinguish between partial and full support, it just counts all children (except in a few exceptional circumstances) and most embassies apply the I-864 standards to the I-134, and ignore anything extra/different. I couldn't say for Argentina specifically though.

No no he puts partially dependent because they don't live with him. My now husband has twins who live with their mother but he pays child support and so we put partially as he does not fully support them SO tick partially ok It does apply to 129 petition so whoever told you that is wrong.

Divorced !st November 2012.

Yes you need to add all the kids, then you can put that they are or are not dependent on you for their support and care....

do not leave nothing out and do not i repeat do not leave nothing out or hide nothing because it will come out and it will hurt you...

just read everything so very carefuly and you will do right.....
