OK to travel to US on valid tourist visa while K-1 is pending?

I'm actually going to see my fiance in two days for seven weeks; I'm taking along a copy of the NOA1, a letter from the government saying I'm expected to return on the 22nd July - I'm on financial aid at the moment as I don't have a job, a letter from my fiance's mom, and a thing saying I have a doctors appointment on the 27th July. Also will have the return ticket. I'll let you know how I go getting into America, lol. Hopefully all will go well! Just have to proove that you aren't going to get married illegaly or overstay.

So he can come but there is a chance he could be sent back at the POE? Umm..how is that possible or why would that happen?

He's been in the states half a dozen times over the last five years. As long as he shows his return ticket, why would this be a problem?

Barbara J I doubt we will be approved by July. I have called everyone, Senator, etc. Sent the RFE response back over a month ago. We are told that our background investigation is still open. I think some kind of false hit might have been found as FI as a common last name - who knows how long that could take to resolve. Even if it got approved this week, by the time NVC send the petition to the consulate, consulate sends invite letter, he schedules appointment, gets approval, packs up his life in Mexico...it will be at the earliest September when he would get here

Oh I am sorry to hear that but will keep my fingers crossed for you. Really it should not be an issue for him to visit not all customs officers are awful and mean. And if he has visited before then ppphhtt he be right lol just have his NOA1 and his rental agreement if they ask.

I hope so! Thank you though, it's good to see another Aussie who has done it. I'm still going to say I'm vacationing with my fiancee and his family, and if asked, I do have the proof that I'm returning, guess I'll find out! I'm sure I'm just stressing over nothing really!

I don't think US immigration system is illogical and broken. Don't forget that no other country in the world is more hated/feared by it's enemies and more coveted as a place to live by everybody else than is the U.S. By scrutinizing incoming visitors regardless of what status they might be in there is a higher probability of detecting foes.

I disagree. From my EIGHT MONTHS of experience, I now know that our immigration system is a joke. There is no reason on God's green earth that we should be waiting this long. I have no criminal record. I pay my taxes on time every year. I am an upstanding, professional citizen in my late twenties. I have been dating my fiance for four years. He is also an upstanding, law abiding, tax paying citizen in his country in his late twenties with no criminal background. He works for the Mexican subsidiary of a large U.S. corporation. He has a valid US tourist visa. Why would they have issued it if he was a criminal? Why are they taking eight months to verify our "background"? We have never been married previously. Neither of us have children. We met in real life, not through some online dating site. You would think we would be the perfect example of a case that should get whisked through the immigration process in 2-3 months. NOT EIGHT MONTHS.

Personally, if I had a choice, I would probably live in France or Italy. The U.S. has major problems. In terms of the security situation and the standard of living, it is better than Mexico, which is why my FI and I decided to try to live here. I also love Whole Foods and Target. But other than that? I was treated with respect and dignity in Mexico. Neither my fiance nor I have received such treatment from the U.S. government here. It is enough to make me vomit.

Landed in LAX yesterday, had all my proof ready, letter from my fiancé's mom, copy of NOA1 etc...

The man just looked at me, asked if I was here on vacation, I said yes (If he asked more question I was prepared to tell him I'm visiting my fiancé, but he didn't), took my fingerprints, took my photo. He asked me if I was going to Vegas and I said no (No idea why he asked that, since on the customs form I clearly wrote I was going to Wisconsin). He said "Have a nice vacation" stamped my passport and I was on my way.

He did seem to spend ages scrolling down his screen though (Could see him scrolling his mouse) as if looking at something, not sure what, but hey, I got in no worries so it doesn't bother me!

BTW, no issue with my fiance coming to visit during the K1 process. Officer's didn't even ask about it.
