I864 ???

hey guys....

i have a BIG issue on filling ( not me but my husband) the I864

here is the thing.. my husband has a self employment and he needs a co sponsor thou , that is not a problem...he already have a co sponsor...

now we are trying to put all the stuff he needs to send with the AOS pakcage...we're talking about the TAX here...i told him he need to send the tax return transcripts but he said he already have these " Form 1040 US individual Income tax return " for the last 3 years...so i was wondering if these papers should do it or not??

we really not looking on getting an RFE so please if u guys have anything that can help us please dont hesitate....

AOS INSTRUCTIONS

IF you paid U.S. income taxes, you MUST submit a copy of the most recent federal income tax return with all supporting schedules and/or W-2s, or an Internal Revenue Service (IRS) transcript (even if the sponsor filed electronically). To request IRS-generated transcripts or copies of a tax return, visit the IRS website.

◦The tax return must have all pages stapled together in the correct order.

◦If you did not file a tax return, attach a written explanation and a copy of the IRS publication showing the filing exemption. For information on income tax filing requirements, visit the IRS website.

Send in 1040 and w2 and that is all you need for 2010

1040 and W-2 is NOT all you need. If that is all you filed, OK, but it is not in your case since he is self employed (even if he were not). You must sned the ENTIRE tax return including any and all schedules that you filed plus all W-2's, 1099's and so forth.

PLEASE just either call the IRS help line or go to their web site and ask for three year's tax return transcripts (you will get them in about a week)--in this way you send NOTHING else and the chances of an RFE relative to tax returns is essentilaly zero.

Mrs. O had the corect answer for you and Barbara did not (her answer is incomplete since it only addresses a simple return as an employee getting W-2 and not someone who is self employed who will either have 1099's or nothing)--ALWAYS read the instructions which Mrs. O gave you--they are very clear about sending entire tax return OR the transcript.
