Timeline

Somehow our k1 application is MIA...

We are now wondering should we just plan a wedding and get married in the fall...and apply then as what a k3? is it?

Advantages/disadvantages? thoughts? timelines differences? cost differences? if we get married can i enter the US later to visit? or would that create an issue?

help...

im just not getting any younger and we want a baby...:)

What you mean MIA? Did you call USCIS? Ours took really long time too like 6 month to get our K1 approved and we are still waiting for interview.

The only thing I think it was better for us to get K1 instead of K3, I really didn't know how to obtain paperwork and marriage certificate over in her country. It takes about a month to get marriage certificate for us in her country and I didn't have that many vacation days.

K1 was very simple, I went there and took lots of pics and asked her to sign some of documents and I was ready to go to USA and filed K1.

When did you file your K1? What was your NOA1 date?

And please tell more about MIA? So you are approved but no one can find it? DId you get a NOA2?

I remember you posting a thread about this not too long ago. You just joined VJ in January and you have no timeline.

So, just as an assumption, let us say you filed in Jan for K1. California Service Center is about 80% complete with Jan filers as Vermont is behind them at about 50%.

Lately, the trend has been a little over 180 days to be approved. So you would be in the window of opportunity for approval soon.

If you do get married, then you will have abandoned the K1 as it is a fiancé Visa only and lost the past 5 months of waiting plus the visa fee.

Now you propose a wedding this fall, then once you are married, then you can start the CR-1 process and start from that point with a new period of waiting. Currently, it is taking on average about 225 days from NOA1 until interview for the CR-1, so let's say about 7 1/2 months from when you file this fall.

But, that is all an assumption. Back to the question at hand, what do you mean MIA??? More information on that would be quite useful to help you.

On another note, to visit after married, you will still need to show compelling evidence to return to your country as the US considers anyone visiting as "an intent to immigrate". It may or may not create a problem. I have read a few cases where it was and a few cases where it wasn't.
