Hey guys 'm a canadian heading to america obviously and I was just wondering the part where it says i need to bring evidence of support is that the papers such as pay stub and tax returns ? thanks.

Yes. I included tax returns from 2008, 2009 and 2010 as well as a letter from his employer and pay stubs from January - April.

I'm nervous about that because my Fiancee hasn't had any tax returns from the previous years because she just finished school and was not working.

I'm in almost the same situation, actually, except my fiance still has one semester left. We have his mother as a co-sponsor, but I am a little worried. Does anyone have any experience with this sort of situation?

I don'y even have a co-sponsor she's looking for a job right now that will make over $18,000 a year.

I think you should look into getting a co-sponsor.

We don't want to ask someone else for money. If we can't do it on our own then we can't get married.

The USC needs to earn more than the required 125% above poverty line. You might want to check into it.

Last time I checked the poverty threshold for all states but Hawaii & Alaska was $ 14,570 USD for a household of 2. Your fiance will also have to prove she is residing in the US and can accommodate you. Rental contract and electricity/water bills were sufficient when we interviewed.

My 2 cents : wait until she does land that job before applying. Without a job and a sponsor the USC will most likely see his/her petition denied.

Yea well I mean it really is all down to the wire with us and has been the whole time,I think the poverty line for places outside of Hawaii and if your not in the military is a little over $18,000 ( I can't remember the link with the poverty numbers) so technically a job that pays $12 at 40 hours a week is enough.

It will be great if your fiance can get a job that will pay the requirement, however the lack of tax returns and the fact that the job will only be a few months old will work against you.

True. The lack of tax returns is because she was a student and didn't hold a job. She didn't need to pay for school because her mom worked at this school long enough where she got tuition free. So she just got out of school a few weeks ago.

I understand that, which is why a co-sponsor would help. Without one, I don't see how your petition will be approved.

ughhh really they wouldn't approve it ? On the site it says if you can't show tax returns you need an explanation and it also says they need a letter from your employer which would obviously state that my fiancee works there and ( if she is under salary) plans to work there for at least the year.

How could a new employer guarantee that your fiance would work there for a year? If she gets a job today, the job would only be a few months old at the time of the interview. Would an employer that just hired her really provide a letter that states she is guaranteed a job for a year? Seems unlikely, IMO.

It seems odd they would deny someone just because the petitioner was a former student and has a job that a a few months old I mean technically we have everything they asked for seeing as they don't ask that you be at your job for more than 6 months prior to petitioning or anything like that, and only ask for previous tax returns or a reason why you don't have them.
