Where can I notarize y wife signature in Morocco

Hi All,

Please if any body have done such a thing before, I need to notarize my wife signature for a POA. Can this be done in US consulate or US embassy in Morocco. FYI, regular Moroccan Notary was not accepted.

Thanks, I would really appreciate a respond based on experience or a known scenario

I need a little bit more information ( I am a notary) Is she a US citizen or a Moroccan national and are you a Moroccan national? The document itself for a POA is very important. What you will need is a durable power of attorney and then what needs to be noted on it are the terms of the notary, ie for real estate, medical decisions, etc.

The document itself should be a very professionally done one. You can get them offline and pre typed.

Please explain its use and then I can better help you

The POA is prepared by a Law Firm for mortgage, I'm a US citizen , and my wife is a Moroccan National, the Bank Investors refuse anything but an US notary.

Ok .. I actually work in the field.

I think that its the title company or lawyers office that is being a pain. The only paperwork that your wife needs to sign is a deed because when you apply for a mortgage, only the applicant needs to sign. Unless you are buying a shortsale and they are asking her to sign something.

There is a solution. An actuary from an American Bank like Chase Morocco could do an affadavit of signature complete with stamps, etc on letterhead. I just had to deal with a client from Brazil and honestly, they werent put through that. Its actually the title insurance company that is giving you a hard time because of title insurance, not the investor. Investors dont look at notary stamps. Is this a loan modification, shortsale or sale?

Ok this is what I would do.

Since you cant exactly get a POA from an American notary, have a fancy document printed up called affadavit of signature to be attached to the notary. Then have her take it to CHASE or some American bank and see if they have someone on hand that can verify her identity.

Another interesting idea is this. Fed ex her the actual power of attorney or a copy of it. Have her go to an office such as a lawyers office that deals with Americans and expats, have the lawyer who was educated in the US or UK witness it and send a copy of his credentials. The title company or lawyers office is really just being a pain in the butt because the only thing a non applicatn wife has to sign is a deed and unless you are selling something its not their problems. You just need to make the papers look very stamped and important and in my opinion, lets find an American lawyer in Morocco because many lawyers themselves can perform affadavits. ( I work in this mess of a trade.. with scary financials and helping people pull out of foreclosure so I know.. I know..what butts they can be.

A moroccan lawyer thats familiar with English can also maybe find a way to make a document that can be used in lieu and a document created by a Moroccan lawyer can then be copied as a true copy by a government agency

I honestly think its just the title company being ridiculous. There are no American notaries in Morocco . You have to carry a state license and be bonded. They need to be a little bit more open to ideas. The brazilian investor I know wasnt put through this. I think they are just being pains..

What state are you in? I can call a title person here and ask them what they think will work

Ok . I just read your pm. What you need to do is talk to a LOCAL TITLE COMPANY and ask them how they handle foreign spouses. The title company cant say oh I want an American notary in lets say Brazil. I think they are just being a little racist and a pain. If it was the uk, they wouldnt be such butt heads. This is what you do. Tomorrow morning start calling title companies and trust me , they are ALL looking for business. Tell them your wife is in Morocco and you are a us citizen and she isnt even on the mortgage. Tell them you can provide proof of marriage, copies of papers and any ridiculous thing they want. Then you tell them all I need please is the solution to her sig on the deed. All this mess is just over title insurability and any title girl worth her salt would accept a deed with a moroccan government seal

If you need me to call someone that you actually get ahold of for me to tell them what the heck to do, pm me their phone ok? I will call the title company . And if your closing is in Florida, you need to tell that lawyer that you want another closer because a title company can do the job that this lawyers office is torturing you over.

Old republic has an entire section on FOREIGN APOSTALATES. Another option is a BRITISH NOTARY because someone with a British Bank could authenticate as well.

I think your best bet is to talk to another title company. This sounds like just a title problem the more I delve into it

No, you're right, it is the consulate. The service is available during US citizen services hours. Moroccan citizens are permitted to use this service if they can produce documents to be notarized for use in the US. I've already gone through the whole process of emailing them and asking them about it. Here's the email:

No, you're right, it is the consulate. The service is available during US citizen services hours.
