Timeline

We just received a letter from the USCIS stating they received our petition from the DOS to be reviewed. Anybody know about how long this review will typically take before we hear from them again? I know they say 120 days, but am asking people who have gone through this before. Thanks a bunch!

120 days is probably the minimum. You are looking at a process that is typically a year or more. We ours was returned it was almost a year later and another petition pushing it that we heard that " it has expired"

This will not be over quickly. You will not enjoy this.

I am in the same boat. Our case was received on April 3oth, It wll take about four months.I keep in touch with my senator's office. They have reached out to them to address concerns that I have on my end.

I think each case is different, but this is my experience with the I130. The longest part after the initial interview for us was waiting 8 months in AP before we were told that they were sending the case back. Once the case was finally returned to USCIS, it took less than a year for our case to be re-affirmed and a new interview date.

We reached the 120 day mark and I called USCIS. They told me that I could have called a month earlier. I put in the service request and recieved the paper (can't think of the name right now), telling me what the situation was and that we had to respond within 30 days from the date of the letter. This gave us less than 3 weeks to put everything together and get the documents to USCIS.

They again said that we should hear something within 60 days. At 60 days, I called and put in another service request. We got our re-affirmed documents shortly after that.

I know that it is very difficult to find information on this and it is frustrating.

From that point, USCIS sent the documents to NVC. It took the NVC 2 or 3 weeks to forward the documents to the embassy. (It does not go back into the NVC automative system...so, use the operator each time you call.) I never did get a straight answer on when they forwarded it to the embassy.

At this point, all communication is with the embassy.

The embassy gave a new interview date for two weeks after they received the paperwork. I emailed the embassy asking what documents they needed. Every embassy is different. They only asked for new medical, new police report, passport, 2 photos, and the form ds230. After the embassy said he was approved, they said to send new tax forms and the passport and they would issue the visa.

I hope this helps you. When I was going through this I was going crazy trying to get detail by detail of the process. I hope that the process is very short for you. My best advice to anyone going through this is keep the faith and trust in your relationship and your spouse. Best of luck to you!!

As another poster said from their story do be sure to file the service requests after the days have passed that they said they would review your case. You can't do them before the expiration of that time but you can do it the day after and that might speed it up for you. If you don't do the service request then it could just sit on someone's desk. The squeaky wheel, as they say. Good luck to you!

Our congressman got a response from the USCIS saying it will take 180 days. We've been apart almost 3 years, what's another 6+ months?? I think I am now hoping to be together by MAYBE the beginning of 2012.

Try not to stress...I know how difficult this is. Mark your calendar and when it hits day 120, call USCIS and put in a service request...if you haven't heard from them. I have had to put in more service request than I could possibly count. I got pretty quick responses after each one. Hopefully this process will not take a long time for you.
