Son turning 21 soon - what may be his chance to get K-2 visa in case our 129-F is approved ?

Hello VJ members !

Greetings of peace!

We are still waiting for our NOA2. My Fiancé listed my own 3 children in his 129-F Petition as we really hope all of us to be together as one family. We are not very sure though if my eldest will still be included in case we get approval soon. When the petition was submitted last February my son was only 20 years old plus a few months thus my Fiance included him. To date, 2 more months he is turning 21. We are very much aware that only 21 years old below may be considered for K-2.

Questions :

1. What is the possibility for my son obtaining a K-2 visa?

2. Will the US Embassy consider the date of petition filed or the interview date ?

3. What is the next option for my son (21 years old then) in case my K-1 visa is approved ?

We hope anyone who has knowledge or experience on this case could shed light or clarification. This would mean a lot to us once we get our NOA2 – God’s will – as we prepare for the next steps. Because if my son will no longer qualify then we will not anymore pay for his visa fee, medical fee, etc so we won’t be wasting our limited resources.

We really have no idea before when we started our K-1 visa journey, but finding this very informative and helpful site is really a great blessing from God especially we have not consulted any immigration lawyer.

1) almost nil.

2) does not change the fact he is aging out

3) in order to immigrate you must become a US citizen and petition for him. He would be several years away before getting a visa

Thank you for the advices. Are you saying also that we should no longer try or pay for his visa application just in case after we get our NOA2?

There is no paying until such time as you actually make a visa application and that appears to be weeks away yet. The time clock is ticking and I suspect it is physically impossible for all of the remaining tasks to be completed before his birthday.

You say you are still waiting for your NOA2 (1-2 weeks?, more?), the file then needs to get from the USCIS to NVC and then on to the consulate (2-3 weeks typical). Then your file must get into the consulate appointment system and an interview date granted (2-3 weeks? not sure for Manila). Then the visa needs be issued (1 week?). The child must travel to the USA and enter. All of this needs be done before he turns 21.

Thank you so much for the clarification. We actually thought of that but we are not very sure as we hope they follow the date of petition filed. At least now we are cleared and can focus later for my son. God bless !
