K1; Anyone that has been through this please help!!!

Ok so heres my story. I personally submitted my K1 visa I129f back in Nov. '10. Received NOA1 (receipt notice) on 11/17/10. Received NOA2 (approval notice) on 04/13/11. Now on 04/27/2011 i received a letter from the NVC that they receive my approved petition and to let me know that within a week the petition will be forwarded to the "visa issuing post" (is this the CDJ consulate?). it has info her name, ins receipt#, barcode, case number beginning with CDJ and where it will be processed. it also says that she will soon receive a packet with instructions. is this the infamous packet 3?? what will be included in it? what does she have to do? what do i have to do?? Specify forms please...what do they do at this point? WHAT HAPPENS AFTERWARD? ANY INFORMATION WILL BE VERY HELPFUL AND APPRECIATED. what fees should i be aware of??

This is the only consulate I could find for Mexico, so I am assuming this is yours. If not go to the Embassy Info tab and find your embassy. All the information you should need will be found there. If not hopefully someone will come along here that has more experience with your country.

hello, its a little nerveracking but i have just one question, when she replies to the consulate to say that she is ready and has everything neccessary to setup the interview, what does she send CDJ?? just the ds156, ds156k, and both i134s? or just the letter they send her? do we have to do anything online because its giving me an option to file a ds260??

You and your father will both fill out the form I-134.

I have heard that some Embassies/Consulates do not accept co-sponsors. I don't know if Ciudad Juarez is one of them, you will need a CDJ specific answer in that regard.

She will not send the stuff to Juarez...she will need to gather it all & bring it in person to her interview.

We are just about a week ahead of you.

CDJ is Cd. Juarez...she will need to go there to interview before she can get her visa.

You will get packet 3 in the mail...and she will as well in Mexico if she lives where they have good mail service. We don't expect the packet 3 to arrive all the way to Cozumel so we are traveling to Cozumel with the packet (copy) we recieve in the USA.

In this packet will be an open interview date letter of invitation, she will need this to interview! DO NOT LOSE IT!!!! just in case she never gets a copy.

She will need everything they ask for in the packet, like police reports saying she has not been convicted of any crimes from every city she has lived in since age 16, plus her pass port, birth certificate (long form original copy...you get these in the town she was born)

You will need to pay in advance online when you reserve your ASC appointment (this is a new thing in Juarez where they take pictures & fingerprints) you will need to get her medical done the day before she plans to interview, and then next day interview! then she may wait several days for the visa to be delivered to DHL (delivery service)

hi kimchimex, ok so what does packet 3 include is that where her ds156, ds156k, and i134 are included? is it better for me to do those online and send them to her so she can sign them, or do they not be signed? i can prepare them no?

Glad Kim came along! I do not have the answers to those question, I'm sorry.

I can tell you though, to just get your head on straight and get it done! :thumbs:

This is a trying process for all and you have lots of people to help you with both aspects, emotional and paper work! The emotional takes more of a toll than the paperwork unfortunatly :( But we're all here to help!

I know some things have changed since my husband went through Juarez back in Sept, but he did not need any police certificates. I checked the Consulate site and looked at the 'packet 3' info, and it still states the following:

"5. Persons convicted of a crime must obtain a certified copy of each court record and any prison record, regardless of the fact that they may have benefited subsequently from an amnesty, pardon, or other act of clemency."

You only need police records if you were ever convicted of a crime. Where did you find this info about you needing police reports from every city since the age of 16 when going through CDJ for a K-1? I have never heard of this.

As was said, you do not mail anything to Juarez. You will send your financial papers to your fiance to take with her to the interview. She will bring with her all the forms she needs filled out. Some will be online, and some of them she will bring with her, and sign in front of them. The English translation on the first page has a typo.. she will need to fill out form DS-260, as listed in the Spanish instructions.

I think you are correct about police certificates not being needed for fiancee visa...however if it is simple to get an antecedent de no penales (spelling) basically a paper from the local police that says you don't have a record...they are like 15 dollars. We will get one cuz it is easy & she has only lived in the same little town all her life.

There is conflicting info on this from everyone i have questioned! we are going to error on the side of caution :)

We just had the K-1 interview a month ago and got police certificates because of these two reasons:

1. This is from http://travel.state.gov/visa/immigrants/types/types_2994.html where they explain the K visa and it's requirements.

"Required Documentation

You, the foreign-citizen fiancé(e), (and eligible children applying for K-2 visas) will be required to bring the following forms and documents to the visa interview:

  • Two (2) Nonimmigrant Visa Applications, Form DS-156 (prepared in duplicate). NOTE: K-1/K-2 visa applicants should not fill in Form DS-160, Online Nonimmigrant Visa Application
  • One (1) Nonimmigrant Fiancé(e) Visa Application, Form DS-156K
  • A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions)
  • Birth certificate
  • Divorce or death certificate(s) of any previous spouse(s) for both you and the U.S. citizen sponsor
  • Police certificates from your present country of residence and all countries where you have lived for 6 months or more since age 16 (Police certificates are also required for accompanying children age 16 or older)
  • Medical examination (vaccinations are optional, see below)
  • Evidence of financial support (Form I-134, Affidavit of Support, may be requested)
  • Two (2) 2x2 photographs. See the required photo format explained in Photograph Requirements
  • Evidence of relationship with your U.S. citizen fiancé(e)
  • Payment of fees, as explained below"

2. Also because on the middle-bottom portion of the DS-156K http://www.state.gov/documents/organization/82063.pdf there is a box that lists the documents that "must be attached in order to apply for a fiance(e) non-immigrant visa". One of the things listed is "police certificates".

I did notice the latest version of "packet 3" does not list it although previous ones did. I agree it is unclear so it's obviously up to you if you want to take the chance. The worst thing that could happen is that they'd tell you at the interview that you are missing a document and you will be given a chance to obtain it and come back again.

my fiancee applied for k1 visa petition to uscis agust 23,2010.december 31 when the usics approved the petition.januarry 11,2011 when i got a mail from the american embassy.may 16 will be me and my daughter's medical and may 24 will be my interview and may 25 will be my daughter's interview...

the most awaited moment will soon to come :)

You can also search for Mexico Police Certificate here on VJ, and there will be previous posts about it stating Mexico is listed as a country where they are unavailable.

If you can get one, it won't hurt at all to have it. I just do not believe it is required.

Does anyone know if the people going through Juarez now are being specifically asked for a police certificate, even if they have no criminal record?
