senatorial expedite help at consulate K-1 visa

hey guys,

My fiance is from england and we received our NOA2 on monday (4/25/11) which is awesome! and the only way that it happened was because we contacted a senator who asked on our behalf to expedite the process due to financial loss if my fiance is not in the country by our wedding date (july 16th 2011). I HAVE read that the london consulate will sometimes move up interview dates if there are concrete travel and wedding plans which we have both. What i basically need to know is who should the senator contact now? the NVC? or the London consulate? and what is the best form of contact for someone contacting from the US. Has anyone ever gone through a similar situation as in had a senator expedite the case at the consulate level?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All the Senator or Rep can do is ask on your behalf. It is up to USCIS to grant an expedite request. You have painted yourselves into a corner by making plans prior to having the visa issued.

Financial loss related to a planned wedding is not a typical expedite circumstance. If it was, every couple would make non refundable deposits and claim hardship.

It cannot hurt to have your Senator's office make an inquiry. In the meantime make sure that you are well prepared and all filings are correct. Missing or incorrect documents will cause delays that only you can overcome.

You waited more than 5 months for the NOA2. This is not an "expedite" Your Senator contacted them and may or may not have mentioned your hardship, which does not wualify for an expedite, and your case was approved coincidentally. I surmise it would have been approved the same time anyway. 5+ months is the average right now anyway.

DO NOT make palns involving the risk of money until the visa is in your fiance's hand. If you do, then be prepared for the consequences.

The quickest way through London is if you've already got your London things done. A senator can't help if you're the hold up. The day London logs your case..BAM! he sends his things in.

we have everything ready to go for as soon as the embassy gets his information. we know everything that needs to be done and when and it is all taken care of all that I am asking is who to contact and i am NOT asking for judgment on the fact that we planned our wedding.

I think that the reason was probably you had reached the five months which is when a Senator will take action.

I also understand that your planning was probably done prior to knowing how this process works and the timeframes involved.

My predicament is not exactly the same but the timeframe is critical. If we all knew all the 'ins and outs' of it before we started the process, we would probably do things differently...its a pretty harsh and stressful process. Wow isn't hindsight a great thing. You could maybe contact the embassy/consular office to see if they have any cancellations/spaces become available.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .
