I-751 troubels !!

hi all;

i need some help plzzzz ! i moved to us on march 2008 on a (k1 visa )...got married and i got my 2 years GC ..i have been in the states for 3 years now ! last january 2011 i filled I-751 for Removing conditions.. to get 10 years GC ..we filled jointly me and my wife i got a letter from uscis to go get biometrics wich i did .and they sent me a notic says that i am allowed to stay and work in usa for another year while i am waiting for my GC ... but last week i found out that my wife wrote a letter to Immigration and went and talked to them about us cause our relationship is not going good and she wanted them to call us for an interview and she wanted it separetly i don't know what she is planning on doing ! but we still married and we just filled taxes together ... but i don't live in the same house with her right now because of my job and we did tell immigration about me not living with her when we filled the i-751 ...i just wanna know if what she did will cause me a problem? and could she get me deported ? and can i get my GC after what she told them about us having problems ? Any answers will be appriciated !thank you !

Yep, thats a big problem. You either have to be in a current marriage or divorced and it seems like your wife is going to tell the immigration officer that your no longer a couple or something worse. It seems like you have problems in the marriage and that wil be a problem for your I-751.

Read this:

If you are still married, but legally separated and/or in pending divorce or annulment proceedings, and:

-You filed a waiver request. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment (if applicable).

-You filed a Form I-751 petition jointly. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment and a statement that you would like to have your joint filing petition treated as a waiver.

Upon receipt of the final divorce decree or annulment within the specified time period, we will amend the petition, to indicate that eligibility has been established for a waiver of the joint filing requirement based on the termination of the marriage.

Hi fellow brother,

Im sorry to hear that things are not going well between you and your wife.

I thik first thing first: You need to talk to your wife so that both of you understand what is at stake here. The immigration process is related to your wife therefore, whatever she does is going to have an impact. You guys need to talk and find a solution.

The good news is that immigration doesn't care if your marriage is not working right now. All they care about is if the marriage was bona-fide from the beginning. I have seen many people from other country divorcing before their immigration process ended (In this website), it wasn't a problem. So why should yours be automatically considered fraudulent?.. Unless yoru wife tells them that since the beginning, all you were interested about was the immigration and not your relationshp.

So: 1) Talk to your wife. Separation doesn't mean messing up your immigrtion process, unless she thinks (And rightly so) that you were only interested by the paper. That will be hard for you to "Unproove"

2) Make sure you have good proove that the relationship as bona-fide from the beginning.

Life happens, so make sure you guys don't make follish decisions based on anger and pride.

thx bro, i appreciate your answer ! i talked to my wife about it and she said that she's going to talk to them again and try to solve the problem ..but i can't trust her anymore after i found out that she went behinde my back and toled them that we are having problems in our marriage !

How did you find out she talked to immigration? Did she tell you or did someone else? And if she told you, was she angry or were you in an argument when it happened? If angry or in an argument, that gives strong evidence she wants to get out of the marriage and that she possibly has ill-intentions. Are you still co-mingling your finances? If she's hostile toward you, watch the money. It might give you an indication she's socking $$ away for her escape.

Do you have strong proof you entered into this marriage honestly? If so, gather it all together -- even more than you submitted for ROC. Put it in a decent order -- for instance, all financial records -- put them in date order; vacations/photos/personal info, in date order. Gather affidavits from people who know you and your wife and know that the marriage is/was real. Get a letter from your boss stating why you have to live apart.

You want to walk into that interview, if granted, with strong evidence about the marriage up until this moment. And then, like Mehmet in the February group, you'll hopefully be given a hearing at some point in the future.

I'm hoping that there is no abuse in your relationship coming from your end. If that's why she wants to have a separate interview, no telling what will happen.

You wont have any problem as long as you entered the marriage in good faith, right now the problem is you've already filed jointly and perhaps you might have to file for divorce so they can treat your ROC as a waiver. This is where this process suck big time, your case will be on hold until your divorce is final or until you guys have decided to work your differences.

hi thx for the reply; i found out that she talked to immigration from a copy of a letter she sent to them after we filled the I-751 !and yes we did have an argument about it and she also told me that she went and talked to them in person ...she told me it was a mistake and she will try to fix it but i don't buy all that !! i know she is trying to find a way to get me deported but what's holding her back is that she co-signed a student loan for me she is afraid if i get deported she will have to pay for the loan so she went and talked to immigration to see if she can find a way out of it !!!also i have evidance that i was married to her in good faith we have been married for 3 years now ...and i never abused her or put my hands on her wich i'll never do to any women ..!!

USCIS has nothing to do with her co-signing a loan for you, this is not an immigration problem. There's no way out of this loan until paid in full.

I think you will be fine as long as you follow the above advice. Many immigrants have fallen into similiar situations and were able to obtain GC and remain in the US! Good luck, don't stress to much and geet your evidence in order. Sorry to hear of your issues. Kp in mind that nearly everyone who has gone through this process has experienced problems in their marriage as well as those who are both uS citizens. This in no way means that you had ill intentions in marrying your US wife. Life is perfect for no one!

I think I can understand where your wife is coming from. I think it is wrong to do this, but often when the marriage goes south, one party becomes vindictive. In the case of an immigration based visa the first thought is to get the other party deported. In that case it may come down to your word against hers. Not sure how immigrations will look at it if she presents things one way in the letter and then tries to present them a different way later. Either way, you are in for a rocky road now I think. I would suggest getting together all the documents, joint bills, pictures and other evidence now so that you have it and don't have to worry about your spouse destroying or withholding anything to make it harder for you. Not saying she would do that, but in another similar thread, that is what happened and the beneficiary had little evidence to prove the marriage was bona fide.

Wow. My husband and I went through a rough patch and were contemplating divorce and the last thing I wanted was for the decline of the marriage to result in his deportation. What a horrible thing to do to someone who has given up everything to come to the US!

Anyway... Glad Vodoo's relationship didn't involve any abuse. (Though it seems that if anyone has suffered abuse, it is him.) With proper evidence, he'll probably be OK.

What a foolish thing she did to try to get him into a bind with immigration over a student loan. She knows very well that she's responsible because she co-signed.

I guess the good news is that she has every reason to NOT want Vodoo deported now that she clearly knows that she can't get out of that loan and she'll want him around to pay it off so she doesn't have to. She might very well be telling the truth when she says she wants to fix what she has done. I think immigration already has a pretty good picture of what kind of person she is.

thank you guys for your support and advices ...i didn't hear nothing from Immigration yet !! it has been two months now since biometrics! :unsure: ,i am trying to find a way out of this miss ..so keep me in your prayers and i'll keep you posted !
