Hello fellow visajourney,

I would like to ask question regarding citizenship. I file K-1 visa(fiance) to my wife now did all the process and now she got her 10 year Greencard, we would like to know how long does she has to wait before she can file citizenship? is it 90days or 9 month from the time she got issued the greencard?

your married so its three years you can apply for citizenship,three years minus 90 days.if living togather all three years,your single then it's five years to apply.

I didn't get what you mean. Here's more info about us. she came here Oct 2007 and we got married Nov 2007. The GreenCard says Resident since 2008 and expried 12/13/2020. So those these means I have to count from 2008 up to present and if she had 3 yrs she can apply now for citizenship?

Three years after the resident since date on the green card. Can send in application 90 days prior to that date, but not before.

If her conditional card expired 12/13/2020 it means it was issued 12/13/2018, somehow I have a strange feeling this date is not correct. Do you mean her the initial date was 12/13/2008? If so, she can apply for US citizenship 90 days before 12/13/2011. Try and post more sensible dates.

Or are you saying her ten year card expires in 12/13/2020?

In my wifes' case it took the USCIS 14 months and two weeks to get her ten year card with that stupid one year extension we had to live with and attempting to explain an expired conditional card. But they didn't expire her ten year card on her anniversary date of her green card, they expired it ten years after the date they got around to issue it. Meaning that she got to live her 14 months and two weeks for free. But the date her green card was first issued remained the same as her conditional card. That is the day you go by, add three years to that and subtract precisely 90 days is the day you can send your application in.

Actually she didn't get to live here for 14 months and two weeks for free. If her interview application wasn't, misplaced, she would have kept her ten year card for four weeks, but as it was, she kept it for seven weeks thanks to the help from our senator. Meaning she still had 9 years and 45 weeks left on her ten year card. But when she got her US certificate, they took that card back. With all the trouble we went through to get that ten year card, she didn't want to part with it, but did. So it ended up with a great expense and inconvenience for her to have that card for just seven weeks. USCIS came out way ahead on this deal, but used to being screwed by our government. Just tell my wife to bend over and smile, not much else you can do about it.

The card is a mistake - she should've been given a 2-year card. It was up to you to correct this mistake. I am betting you didn't even raise this issue with USCIS or filed I-751. Here's the thing, once she files for naturalization, they will realize their mistake and will not proceed any further until you file the I-751. You want to correct this IMMEDIATELY.

Here's the thing, once she files for naturalization, they will realize their mistake and will not proceed any further until you file the I-751. You want to correct this IMMEDIATELY.

Still need a timeline, if they were married two years before getting her first green card, would have received the ten year card instead of that conditional two year card. Just need the initial date on her green card.

Here's more info about us. she came here Oct 2007 and we got married Nov 2007. The GreenCard says Resident since 2008 -- this looks like a less than two years marriage to me at the time of obtaining residency.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

I think I can help. I too married in Nov 2007, got my 2 yr GC back in Feb 2008. Then last year(2010) I did ROC and got my 10 GC...which says resident since Feb xx 2008.

Therefore I was eligible to apply for citizenship 90 days prior to the Feb xx 2011.....which is 3 yrs since Feb xx 2008 (got all that? :) )

Sounds to me like your wife is eligible now if she's been married to you for the last 3 yrs and has been a perm resident since Feb 2008.

I think she got a wrong Green Card, she should had got 2 yr conditional green card. Which would be ok but she would only be able to apply for citizenship after 3 yrs on GC.
