Timeline

Has anyone on this forum been interviewed having multiple convictions but wasn't required to file a waiver? Trying to get an idea if this is going to be a definite step we will have to complete before a visa might be issued. Thanks!!

Drugs, gangs, sex, domestic violence are big ones for the beneficary

Has anyone on this forum been interviewed having multiple convictions but wasn't required to file a waiver? Trying to get an idea if this is going to be a definite step we will have to complete before a visa might be issued. Thanks!!

If the beneficiary has multiple convictions, do the research on the crimes before applying for VISA. No sense in spending the money and getting hopes up if the crimes are not waiverable.

There is no question with a criminal history unless it qualifies under the petty theft exception that with multiple convictions a waiver will be needed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I have done some research & none make my husband(the beneficiary) ineligible to file a waiver from what I can comprehend..he was denied entry on a visitor's visa in Nov 2009 for a crime involving moral turpitude but they didn't say which conviction that was...we think its the offence labeled "grievous bodily harm". He was in a fight & broke the guys jaw with his fist. The rest were assault(pub fights). All happened in the 1980's apart from a DUI in 1993. No drugs, sex, gangs, weapons or domestic violence. I (the petitioner) have no arrest history.

Hmmm... well hopefully some of this stuff is juvenile? Looks like there is going to have to be some research done on the criminal code. Get an atttorney who knows both US and your home country law and have him compare the statutes and sentences. A strong waiver packet might be able to overcome.

Recommend Steven Heller he has experience in the London USCIS office as an adjudicator he practices in UK but is licensed to practice US Immigration Law.

Take a look at and post in the London waiting forum.. they might have a good answer. You can prepare ahead of time, but they will not let you file until after the interview. Be prepared to pay the fee and submit the packet at the interview they might accept it or require a subsequent interview to drop it off. If he knows exactly what the INA code he is inadmissable.. and the attorney will push for them to "decide" on the date of the interview....sometimes they research it and it adds weeks or months to when you can actually file.

BTW the London I601 folks keep track of the processing time, so pop over to that thread and you can get some idea.

I saw you recommended Steven Heller in another post as well...I will definitly contact him and thank you for all the good advice! I'll tell ya...this immigration process is no joke. Frightening to know that our future is in the hands of these officials. I hope they go to work each day remembering that they are dealing with the lives of real people, not paper dolls. take care
