hi we got RFE and it says that the divorce papers you submitted was incomplete only the 1st and last page was submitted.

WHAT DOES THIS MEANS?WHAT EXACTLY THEY ARE LOOKING FOR ON THE DIVORCE PAPER?TNX

That is what I am worrying too and we got RFE and its the divorce paper and I dont know if they need the original copy or just photo copy..was not able to send it yet but just worrying what to send them..goodluck and hope there is someone who can answer your question here..

There are generally 2 pages to a Divorce Decree. Just a guess but there should be a Courthouse Seal or Stamp on it. Double check what you submitted and/or go to the Courthouse and get a new one. Just a guess.

They want a copy of all pages of the court certified and stamped divorce decree which is on file at the applicable county courthouse where the divorce was filed. If the stamp does not copy well, then send in an original. You can obtain these from the county courthouse recorder.

What constitutes a complete divorce decree will vary from one state to another, but USCIS is usually well aware of how a divorce decree looks from each state. In some states, a complete divorce decree consists of a declaration from the court that the marriage has been dissolved, PLUS a complete description of the terms of the divorce, including property settlement, child custody, and support payments. It has to be signed or stamped by the judge who issued the divorce. The original usually stays in the records room at the courthouse, and the court clerk issues copies and stamps them to indicate that they are certified copies. You can send a photocopy of that certified copy.

1. Make sure it's been stamped by the court clerk or custodian of records.

2. Make sure it's been stamped or signed by the judge.

3. Make sure it contains every single page of the final order.

You are not alone. We got an RFE as well. Most likely same reason. Will know more tonight when I get the hard copy.

Does anyone know if the foreign divorce decree should be translated into English? Can I just translate and mail the translation or should I have a certified translator do this for us?

If the foreign divorce decree is not in English then a translation must be provided. If you are fluent in both languages then you can do the translation. You'll have to certify that you are fluent in both languages, and that the translation is accurate. There is a sample certification here:

I am also divorced and filed for my I-129F April 1, 2011. I am from the Bay Area/Northern california. I obtained 3ea "Certified True Copy" of my divorce decree from the courthouse where I filed for my divorce. This simply means the courthouse clerk signs, stamps & embosses the divorce decree with the courthouse's seal. The cost is minimal. It cost me $15.00 per. I included one with the I-129F, one for the duplicate copy of my entire I-129F, and the other one for future use. My divorce decree included the Judgment which was 2 pages and the Marital Settlement Agreement (essentially an agreement on how you and your ex wanted to settle everything), which was anothe 8 pages. I hope this helps.

We went over this last night in our email... This is what I wrote you:

Sent Yesterday, 10:37 PM

Hi,

They're looking for the Judgment of Dissolution. That is the one with the State Seal on it in colour ink. It has the judge's signature and it's dated. In California the number on the form is: http://www.courtinfo...lable/fl820.pdf

Now one thing is, when you send a 'copy of this' into the USCIS, I would get a COLOUR COPY of it for the STATE SEAL.

You will need 3 copies of this: one for his file as a spare, one for the USCIS RFE, one for the Embassy Interview that you will carry on you (and don't ask me why bc they'll already have the other one in the file that is sent from the USCIS to NVC to the Embassy! Each copy in California is $35-55 bucks; so, this is why I suggest you make colour copy. Note** THEY MIGHT AS YOU FOR AN ORIGINAL of IT AT INTERVIEW btw.

How to send it back : FOLLOW THEIR INSTRUCTIONS LITERALLY and EXACTLY!

1. Always send in a copy of your NOA1

2. Send them a copy of their RFE

3. Attach a cover letter stating you are responding to their request for more evidence and please find attached the Judgement of Dissolution for the Petitioner (full legal name). 4. Send it back to them USPS Priority Mail / Certified/ Receipt Return.

As Jim said, every state is different but it's the Judgment of Dissolution signed by the Judge with State Seal.

Geeze this county cost me $35 per copy and I'm in Nor Cal too! I also had to pay for a different copy of my "Restoration of Name" because the box on my Judgment wasn't tic marked by my Attorney at the time of Judgment! That was only $15 I think. You're lucky because yours was much less!

They [uSCIS] doesn't care, nor need the Settlement Agreement btw, because that is not the document that says the Petitioner is free to marry. They want to see the final Judgment signed by the Judge. Our K-129F was just approved with the Judgment of Dissolution (colour copy/signed by judge, court certified, etc etc etc) and we did NOT get an RFE. I thought I had to send in all the pages too but a friend of mine who is Family Lawyer and had also gone through the USCIS as Petitioner was who helped me with this. Anyway, I think it's only 2 pages I sent in.

:wow: Sorry to hear you had to pay $35.00 per. When I got my certified true copies, it included the marital settlement agreement. So, I sent the whole thing...I did not want to take a chance...:D I am in Solano County by the way
