B2 Visitor Visa interview

Hi,

I have another question about my brother, who is applying for a B2 visitor visa so he can attend my wedding on August 18th.

He has sent off the DS-160 and has all forms ready apart from his ACPO police certificate, which we have been told will be dispatched on 28/4/11. My question is, when do you guys recommend he call the operator assisted number to pay for and book his interview? I have no idea how long London take to schedule B2 visa interviews, does anyone know? We don't want to book it now and get it before his certificate arrives, but we don't want to wait too long.

For London, it says the wait time is 3 days. Surely that doesn't mean I could book an appointment today for say...Friday? Why do K visas take so much longer?! Guess that's good news if I'm reading that correctly.

Why is he not eligible to use the VWP?

(The K1 may be a non immigrant visa but it is effectively treated as if it was one)

K visas take longer because the interview is much longer and requires more document review; hence they are usually scheduled further out. Do note, however, that with a B-2 interview your brother should have all of his ducks in a row before heading to the consulate because the B-2 interview will not be given more than a few minutes. You mentioned a criminal record - have you checked to see if he is admissible to the US? There are a number of convictions which may make him ineligible to receive a visa altogther so you might want to double check. Do a google search on Crimes Involving Moral Turpitude and criminal convictions which lead to inadmissibility.

I suggest you wait for the ACPO...it usually comes quick, within 2 wks. The problem with a visitor's visa is that there is no waiver in the case of a denial. Wait and see what the content of his police certificate shows so he'll have plenty of time to prepare for the interview. My husband was denied a visitor's visa because of his police record and the officer questioned him on particular offenses...he didn't even look at the rest of his documents or paperwork. Answer Honestly, but only what's asked.

Thank you, that's what we've decided. May I be cheeky and ask what was on your husbands record? My brother has 2-3 cautions, but no convictions, will he be okay you think?

Timeline

He had some "assault" offenses (punch ups as he calls them) from over 20yrs ago, one was "grievous bodily harm" because he accidentally broke the guys jaw, a DUI and 1 caution for battery(flicked a guy in the ear) I'm not entirely sure how the US deals with cautions because the INA code refers only to certain CONVICTIONS as being inadmissable. A conviction is being found guilty, but with a caution you are not necessarily, its just like a warning. I wouldn't think he will have a problem but maybe you should post another topic asking if anyone was granted a visitor's visa having only cautions on police record. There's got to be someone out there who was in the same situation..I don't know of many guys who haven't been cautioned by the police at some point in their younger years, and if they haven't they're just lucky =)

Will he avoid administrative processing even though he has 2-3 cautions? (cannabis possession). Really worried that he won't make my wedding :( Does anyone know of someone who has been given a visa without extra processing even with cautions?
