Hello everybody,

We received our NOA2....What papers is now my fiance in the US supposed to send me for my interview?I told him he has to send me copy of 129 form..etc and copies of all the other forms he filled in for the petition he filed but he tells me he is not supposed to send them to me because USCIS already got them....is he right or not?

he needs to send a copy of the NOA2 and the filled out and notorized form I-134 plus all the supporting documents for the I-134 such as

----> letter of intent to marry within 90 days

----> pay stubs

----> last bank statement

----> tax return

----> information regarding his annual income

----> information regarding his other resources

----> employment letter

----> statement from officer of bank regarding his bank account

i think it is not necessary for him to send u the I-129F. it is for ur records but its not needed at the interiew

This is very interesting. Has your man ever sent you a copy (even a digital copy) of the I-129F he filed?

It seems to me he's trying to hide things from you?

I can say that the only reason I would NOT want to send a copy of the I-129F to my girl is if I didn't want her to see the I-129F that I've filed. Otherwise I'd have no problems sending a copy to her. I sent a digital copy of the I-129F to my girl the day I mailed it out to CSC.

USCIS does NOT forbid him to send you a copy of the I-129F application. He has NO reason to say that he's not suppose to send it to you, unless he wants to hide something from you.

Just my 2 cents. I would proceed with caution.

Its always a good idea to have the original form (or a copy) with you. My lawyer has sent the copies over to me and advd me to read them so that i know the family history incase im asked at the interview...

If he is refusing to send them over i would be a little worried too

In addition he needs to start filling out the waiver stuff people have explained to you. Due to your overstay, he will most likely have to fill it out anyway so might as well get started.

Your fiancé absolutely SHOULD send you a packet that includes EVERYTHING he filed, including copies of the I-129F and originals of all proof he submitted of your relationship. A consular officeer has the right to ask to see originals and to ask you questions about any information your fiancé submitted. If you don't have a coy of what your fiancé sent, you will not be in a position to either produce originals or possibly answer particular questions. You're going to have to insist. Perhaps he is just misinformed about the process. Maybe you could direct him to some informational links here at VJ so that he can see the necessity of sending an exact replication of what he sent that includes all pertinent originals.

P.S. Could you take a moment to fill in the timeline that's accessible through your VJ control panel? I see you haven't done that yet, and it would really help us to follow progress of the two service centers. Thanks!!!

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

Correct, you need a brand new letter of intent, original, written by your fiance in the USA. :yes:

Before reading too much into it, there is no reason for him not to send the original I-129F petition, but he could simply be confused. You don't have to have it, especially if you know him well, but there is information which could pertain to questions you get asked at the interview. I would want him to send it if I were you.

Your fiance should send you I-134 with the supporting documents and proof of citizenship.

Ask the consulate you'll be going through whether I-129f, G325As and NOAs will be really necessary, if in doubt.

I only offer advice - not even legal. Just the plain and simple kind.
