Hi. We're in the middle of the K-1 process, and I cant seem to remember...

Is there anytime during the application process before the K-1 is approved when he is not allowed to come to the United States?

As he lives in Canada then No would be the answer, as long as he can prove that there is no immigrant intent, one has to prove that they are going back home.

There is nothing that says he cannot visit you while the K-1 Visa process is in progress. I visited my fiance in the U.S. several times during our K-1 process.

Your fiance needs to bring with him evidence that he intends to return to Canada, such as his most recent pay stubs, mortgage or lease documents, utility bills, etc. And if asked if he has a K-1 pending, he should answer truthfully that he does, and is just visiting his fiance and intends to return to Canada after his visit with you.

There is still the chance he will be turned away at the POE, it is up to the border patrol officer, but as long as he has plenty of proof, and does not lie to them, he should have no problems.

Not that I know, but they must show that they are returning to their country. But that person should be in there country towards the end of the process in order to receive mail, send documents and get prepared for interview. Maybe some here know more than I. Good luck with you visa journey.

That's true. It does not guarantee that the non-USC party will be allowed to enter the States, particularly if he or she has had difficult entries in the past, but there is no specific law or regulation against it.

If the non-USC attempts it, he or she should keep in mind that the burden is always on the foreign visitor to prove a lack of immigrant intent on each and every attempt at entry without a K or immigrant visa.
