We were approved on March 22 and I received the hard copy of NOA2 today (March 26) in the mail. Here is what it said,

"The above petition has been approved and forwarded to the listed consulate(Sao Paulo). Please contact the consulate with any questions about visa issuance, or if you would like to have them forward the petition to a different consulate. The petitioner can also file a form I-824 Application on an approved application or petition with this office to request we notify another consulate of the petition approval for visa processing purposes."

Ok so a couple of questions.

#1 Did this not go to the NVC?

#2 they say the are sending it to Sao Paulo Consulate in Brazil, but the Rio consulate is the only consulate that approves K1 visas in Brazil. Does the USCIS/NVC not know the appropriate place to send the petition to? Or is this normal wording and it gets to the appropriate place? Is this now going to take more time for them to get it right?

Thanks for any knowledgeable input or advice.

USCIS sends approved I-129F petitions to the NVC, who send them on to the consulates. So, to your first question, it sounds like NVC have already received it and sent it on.

As for your second: NVC seem to be having some weirdness lately. They sent two Canadian K-1 petitions to the wrong Canadian consulate as well. I'll tell you what worked for them.

Call or email the Sao Paulo consulate, with the consulate case number you should have received in the NVC letter, to see if they've received your petition. Since they don't have an appropriate visa section, they may already have sent your petition to Rio. If not, ask them to. They'll probably have no problem with that. They won't want to deal with any case they don't have to.

DON'T PANIC

The above poster is incorrect in regards to the NOA2 and consulate.

NVC will recieve it soon. Just keep calling the number. VSC NOA2s always say that it went to the consulate, however, they ALWAYS go to the NVC to get the Case#, which for you will begin like this :RDJ2011XXXXXXXX

Call the NVC to get the Case number and then call back or email every few days. Soon they will tell you it has been sent to the consulate etc.

If you put Sao Paulo on your I-129F that is probably why the NOA2 says it, however, NVC (Which is State Department) will be sending it to Rio and only the Rio Consulate does K-1s

This is verbatim off of my notice. This is why I was confused.

Thank you for your reply and I will do as you say. I will start calling on Monday to see what happens from there.

Once again, thanks so much for your reply...!!!!!!!

When I submitted my I-129F paperwork, I accidentally listed Brasilia as the consulate because I didn't know that Rio was the only place that does immigrant visas. About a week after I received the NOA2 approval, I called NVC and found out that my paperwork had been forwarded to Rio. I emailed Rio and received the interview date. Hopefully you will have the same experience. My petition got to Rio pretty quickly..just a couple of days I think. Also, as the earlier poster said that there have been some problems with petitions going to the wrong consulate, keep calling or emailing until you have confirmation that it is really in Rio. Good luck, and I hope you hear from them soon!
