Wife and Son traveling to Phils

Hi Everyone,

I need a little advice please. My wife and son will be traveling to the Phils without me next month. :( She is traveling with a friend of hers who will also be traveling without her husband. This coupls is jumping through all these hoops making sworn statements, filing afidavits due to the Phils law regarding minors traveling to the Phils-WEG Waiver of Exclusionay Grounds. I've read the law and I have no doubt it only applies to minors traveling without either parent. I have completed and had notarized an afidavit that I understand my wife is traveling with my son without me just in case. I don't see any reason to do anymore than that. But this couple has got my wife all freaked out and trying to convince her that we need to jump through all these hoops like they are. Anyone have any ideas?

I was under the impression as long as the kid has a US passport, then he/she is good.....

I have a sister who is in Japan and she travels to the Philippines several times with her son and the father never accompanied them in any of these trips, and they were fine. My sister and my nephew even have different names since my sister is not married to his father and retains the family name of her first husband and my nephew is using his father's name and never did they encounter any problem...

My sister thought that since it is indicated in my nephew's passport that she is the mother, that's why they dont ask questions.

Like you, we were initially concerned about it, but after the first trip and it proves to be no problem... she never worries anymore...

Some ppl make it big deal and like to make it an issue.

My bro has travelled with my neice and nephew so many times where it was only him and kids and my sis-in-law was not traveling or the other way around.

Unless you have filed a police complaint against your wife that she is trying to run away with your child, immigration does not care, all they care is all the traveling member have valid traveling document.

Timeline

just last September, i and my son traveled to Philippines. My husband followed after two weeks. Before the trip going there, i got a notarized affidavit stating that my husband is allowing me to travel with our son. I used my Philippine passport with my maiden name so i brought my marriage certificate to show the name change together with my green card.I even brought the birth certificate of my son just in case 'cause he got a US passport. Everything went smoothly and they didn't even check the affidavit so tell your wife not to worry too much:)

How long are they going to stay in Philippines? I'm also going home with my US citizen son (husband to follow) and I was just wondering if the minimum 21 days without visa apply to my son because I want to stay there for more than a month.

My Daughter's Timeline

February 17, 2011-- I-130 sent thru USPS (Priority)

February 22, 2011--I-130 Received by USCIS

March 02, 2011-- NOA 1 Received

I miss my daughter's hugs and kisses...

How long are they going to stay in Philippines? I'm also going home with my US citizen son (husband to follow) and I was just wondering if the minimum 21 days without visa apply to my son because I want to stay there for more than a month.

Your husband gets a automatic 1 year visa, It's called his passport.

I would assume your son would be at least a 1 year automatic passport and maybe longer

Just FYI, I have overstayed in PI back when I was a single man, Never had to pay extra they just let me slide at the airport....

They will stay 6 weeks. As a Filipina both your spouse and your children can avail the "Balikbayan Privilege" and stay up to one year without a visa.

I'm pretty sure if child only has US passport then they will have to get a extension if staying for more than 21 days

I see. Thank you. Do you think the immigration officer will ask for the return ticket? I'll buy only one-way ticket for me and my son to Manila and purchase our (and my daughter's) return ticket to US from there.

Yes, he has a US passport. So does that mean, we'll have to apply for extension?

I was wrong. The child gets a balikbayan visa if travelling with filipina mom. Still don't know if hubby gets one when arriving at different time.
