Hello VJ, please i need help, a friends married a USC and they want to file for CR1/IR1...please do both of them need to fill in the F129 FORMS each and 4 G325A forms please i need help.

Well given your profile also shows CR-1 visa why don't you help them file?

Is the non US spouse still in the US with the USC petitioner? Or the non USC (beneficiary) currently resides in his/her homecountry?

USCIS journey:

02/11/2010 - got married

06/28/2010 - sent I-130

06/29/2010 - received by uscis

07/06/2010 - notice NOA1

07/08/2010 - updated

07/10/2010 - got NOA1 hard copy in the mail

11/01/2010 - moved from CSC to TSC

11/02/2010 - updated

11/03/2010 - updated

11/23/2010 - updated (post decision activity)

02/09/2011 - notification moved from TSC (back to initial review :o )

02/10/2011 - confirmation TSC back to CSC!

02/16/2011 - APROVED!!!!!

NVC journey:

02/25/2011 - we're IN :)) case # Emailed DS 3032. Paid AOS Fee.

03/01/2011 - DS 3032 approved (confirmation by email)

03/02/2011 - AOS shows paied -> AOS packet mailed out

03/04/2011 - AOS received

03/07/2011 - IV generated & paid

03/09/2011 - IV paid! mailed out->

03/14/2011 - IV received

03/31/2011 - Case complete @ NVC!!!

It is not necessary to make more than one post on the same question. You have to allow people more than 6 minutes to respond. Be patient and you will get your answers.

If they are married they should file for the CR1 visa. This requires the USC to file a I-130 petition. Include in the petition 1 G325A form for EACH of them, as well as some other documents (please read the instructions for the I-130 form as well as VJ guides to find out what they are).

Do not file the I-129F. The I-129F used to be filed after the I-130 for a K3 NON-immigrant spouse visa, which used to be a viable alternative for married couples when it was taking years to approve the CR1. However, processing times have improved significantly and the K3 is now a dead visa that could even end up delaying the CR1 processing.

According to your timeline, you are in the process of filing for a CR1 visa as well, so you should know what's required. If in doubt, please refer to the guides provided on the site. They are extremely helpful.

03/14/11: NOA1 via text and email (03/21/11: in the mail); petition routed to VSC
