can i visit the US on a visitor visa while i wait to for approval for my l-130 pettition

Hey everyone here

i just got married to my wife who i have dated 2 yrs ago in nigeria last month.she has gone back to the US and filled l-130 pettition and we awaits the approval.But we missed echother so much and i want to visit her and spend some few weeks and return back to nigeria.pls can anyone here advise me on the outcome of this if the embassy will refuse me visa or if it will affect my pettition if i should apply for a visitors visa.pls i need advise

I dont see this being a good idea i know u miss each other however the Lagos consulate is very tough it will be very hard to prove to them ur coming back to Naija once ur visit is up. It is tough to get a visitor visa even when u dont have a pending petition. In my opinion if i were u i wouldnt waste that money. Because the chanced are slim to none.....good luck with ur decision...

Timeline

A tourist visa denial will not affect your I-130. Hoewver, it is also unlikely you will be granted one. You can always apply though

Lagos is a VERY tough consulate, besides - clearly with a pending I-130 you have immigrant intent

Getting a visitor's visa from Nigeria is almost impossible! Specially, with you filing for I-130, they will not allow you to just come for a visit, because they will be concerned that you would stay without first having to go through the appropriate procedures. At this point, wait and be patient, as some have suggested. Prior to filing for fiance visa, my fiance filed twice for a visitor's visa and was denied :(

:thumbs: Very difficult, waste of time & money..... UNLESS you have very strong ties to your country, good job or school, bank accounts, busyness, family to support, children.... and still they can deny you, for dual intent (immigrate before the CR1 is done)

I have flown to the US from the UK a few times while my application was still outstanding, both 1-130 and through AP and have had no problems.

best to get a letter from your lawyer stating that you are visiting and that you will be returning on the selected date.

There are few things that you want to consider as various ppl have answered.

1 – Not just from Nigeria from any country once 130 is filed and is in system, your spouse is not going to get B1/B2 (tourist).

2 – person who visited from UK most likely did not apply for a tourist visa after marriage and 130 was filed, most likely they used VWP.

3 – Person who flew from Brazil could be in similar position where they already had a 10 yr tourist visa stamped.

Also in both case 2 and 3 there was no guaranteed entry at POE office could had denied entry to both and both would had to return back on the next available flight.

Best advice is you guys will have to be patient and wait for your immigration process to be completed.

I'm sorry but visiting from Brazil is MUCH different than visiting from Nigeria. It is highly unlikely the OP will be granted a tourist visa

Of course you can! Most people on this forum have done thier own paperwork. Read the guides in the Guide section at the top of the window.:thumbs:
